NY Gun Confiscation Underway – Citizens Told to Turn in Pistol Owner ID & Firearms

This goes in the 'I read it on the internet so therfore it must be true' category.

Man we need a filter for these things.

Regurgitated internet information that people lap up and repost isn't very reliable.

Remember to trace the information back as far as you can before giving it any credance.

"Forgive me if I mistook the meaning of your post"

The meaning was simply there seems to be one citizen so far - not "Citizens". Maybe later on there will be others, when the state gets organized. Or maybe not.

I read the permit application and almost threw up! That process is downright horrendous. I'm sure glad I live in Virginia.

This really shouldn't be a surprise since the whole point of "may issue" is to allow the government arbitrary discretion.

!

Take a look at this permit application, then ask yourself how this could or could not (?) happen.

You know, this reminds me of an old joke demonstrating how bad racism used to be with respect to the right to vote: where the black guy was required to demonstrate his literacy by passing three tests...the first was to sign his name (on wax paper), the second to solve math problem (involving advanced calculus), and the third to demonstrate he could read (a Latin verse).

The only one he could do was the reading of the Latin verse, which he translated as: "It says 'There ain't gonna be no blacks voting here today'."

:fire::fire:

This <excrement> is every bit as asinine as the days when that type of impossible racist voting stuff was actually invoked.

:cuss:

"IF ANSWER TO ANY QUESTION IS YES, EXPLAIN HERE:" Followed by 1 2/3 lines to explain. Nice.

Provide 4 character references, but you essentially can't use anybody you know or, Heaven forbid, a law enforcement officer as a reference. Nice.

They're a "pass through" agency...but it takes 6-8 months to process the application. Nice.

Sealed records CAN be accessed by NY law during the gun application process. However, I'm not sure about "expunged" records. Nice. Expunged records, however, are supposed to be completely eradicated, period. I wonder if a case can be made for a law suit if one does not report an expunged case during this. Nice. Especially given the NY requirements for sealing a case. (Essentially

The Department of Mental Hygene form...requires no legal consent signatures from the person applying in order to obtain confidential doctor-patient information? Nice.

"List all parties who reside at the listed address, include DOB's and any cellular or other telephone information for each individual listed:" In 1 1/2 lines of space? And WHY is this information required? They're asking for Personally Identifiable Information on third parties? Without any proper legal notifications of such on the paperwork? And isn't cell phone information something that the INDIVIDUAL should give out, not third parties? Nice.

List children? Why? Nice.

List your entire DATING HISTORY for the last ten years? ("significant relationship") Nice.

List children by previous significant other/spouse? Why? And then provide Personally Identifiable Information without the proper legal notifications on the paperwork? Nice.

Do you currently possess any kind of gun or bow? Then LIST them? After being told previously that you have to turn in unregistered pistols to the police? Nice.

And let's back up to the requirement to provide a bill of sale for your guns, too. How many of us have kept the bills of sale for all our firearms over the years? Nice.

List any interviews by any law enforcement officer with respect to any crime? Nice.

Ever been fired from a job? Nice.

Ever used any illegal drugs? Heh! Figure the odds of a "yes" here if there is no legal record. Same for alcohol.

Yeah. "There ain't gonna be no pistol permits here."

Bill4282, what state are you from?

TN - I called back today and spoke with a supervisor. She said she would note my record that the diazepam was for my menier's. she also said she "didn't know why I was asked". Said diazepam is used for many treatment besides mental issues. Not too concerned since TN is pro-gun. Concerned about the Feds passing some kind of law about certain drugs.

Well there's another misconception about this story. And it falls on the government. Anti-depressants/anti-anxiety are NOT intended to be taken long term. Usually less than a year. But there is a catch, after taking these meds long enough you develop a psychologic addiction to the drugs. You believe that you need the drug to feel better. So when you stop it creates anxiety and depression. Most doctors fail to inform their patients of this. And the drug companies profit.

This man did it right. He took them while he needed them. Then stopped. It's no different than taking an anti-inflammatory for back pain then stopping when your back stops hurting.

I hope they sue the crap out of the state over this. It's absurd.

Do you currently possess any kind of gun or bow?
Seriously? They ask if you own a bow?
Well....I suppose kids who watch 'Arrow', 'Revolution', 'Hunger Games', 'Brave', 'Avengers' etc might go crazy with 'assault bows' and 'hi-cap quivers'....and those nifty concealed carry flip-out wrist crossbows (Oops, I think that was the Arrow character on 'Smallville').

Rambo had explosive arrowheads, and those Duke boys were always blowing things up as I recall... Bows are nearly silent killers, except for the explosions of course.

More information on this topic....

Now allegedly, the NYSP are admitting that this was all a mistake. The link to the newsclip by the local NBC affiliate is below:

http://www.wgrz.com/news/article/210049/37/SAFE-Act-Mistake-Leads-to-Pistol-Permit-Seizure

Some takeaway lessons on this:
A) Registration leads to confiscation. No additional explanation necessary.
B) HIPPA is only for us serfs and the Medical Profession. The almighty State shall know and judge all. Amazingly, now LEO's are qualified medical professionals.
C) The State is immune from mistakes. A violation of your Civil Rights only deserves a "sorry for the inconvenience, just doing our job 'keeping you safe'" reply.

Google WBEN, Buffalo, NY for additional information on this.

If anyone wonders why us 2A supporters are upset and now active regarding what is considered "common sense" legislation this is Exhibit #1.

To all in other states who still doubt that such legislation will NEVER be considered in your Legislature; well, guess again.

C) The State is immune from mistakes.

Yet according to the article the librarian must still stand infront of a judge.. For what exactly??

In order to get his guns back, Lewis still has to go to a hearing in front of a judge.

OK, it did happen, but now it's all a mistake. Sounds like maybe, just maybe, the State Police were testing the waters to see what the reaction would be. :scrutiny:

The minute my State notified me that I would have to turn in my guns I would quit my job, pack my bags and move to another State. I would rather be jobless and start over from scratch in a different State rather than turn in my guns.
