NY Transfer Fees

I know it's another dreaded tranfer fee question.

I've asked a couple local FFL's, outside NYC propper, and they want to charge $25-$40 + Tax.
Now, I know they shouldn't be charging taxes, or is there some recent development I missed?

I wanted to see if my fellow New Yorkers have had similar experiences.

Heck, what's to stop me from telling them it cost only $10.00?
 
I charge:
$15 per long gun
$20 per used handgun; for new handguns that need the CoBis casing submitted, thats another $15...because its either a 3 hour round trip or a casing shipped to the NYSP certified mail, return receipt requested. Either way, thats my expense in time and miles on the road.
I charge tax ( out of the above fees ) on the transfer fee if you paid the other end directly and the money never directly crosses my hands. If I am getting this for you from one of my regular wholesalers and you are paying ME, its tax on the full shot.Thats the way the NYS tax law reads, and if your previous FFLs were not charging you tax on the transfer fee itself ( they MAY have been and you never knew it; as I said, I pay tax out of my fee and don't tack it on extra ) they may have been ripping off the NYS tax people.
Also out of the above comes the cost of a new Master Lock meeting NYS gun lock standards that I am required to provide with each transfer. So all in all, I don't consider my fees excessive.
I have not only my FFL fees to recoup, but my state dealers license fees as well. I have to maintain my records and be able to show that I am making some sort of profit and a certain level of activity to keep the feds happy.
Whats to keep you from telling them its only ten bucks? Nothing. But I am not obligated to do any transfer that I do not want to do, either.I'll try to keep you as the customer happy, but quite often a transfer involves a LOT more than simply mailing a copy of my FFL to some guy. I spend a fair amount of time on the phone calling around trying to find a good price for people who apparently don't want to do their own research on what realistic prices for a particular product are.
 
I'm on Long Island.......in the past 6 months or so all the dealers raised their transfer fees. Cheapest I can find now is $35. Some refuse to do them at all now or want to charge $50+ :fire:

Damn reasonable, IMO, and I like the way you break it down, instead of a 1 size fits all. All FFL's should be so straight forward.

The way you put it is very reasonable and appropriate.
Unfortunately they want to charge tax on my purchase price which is totally BS. So, yeah it cost $10.oo.

If you're dong this, then as far as I'm concerned you should be paid accordingly.

Anything more than a pure transfer entitles you to get paid.
All you should be doing is receiving a box and giving(transfer) it to someone else, along with the necessary paperwork thrown in.
 
Twenty bucks at my local shop. When it's been a good day, sometimes it's on the house. But never more than $20.
 
RIPPED OFF

Transfer fees are paid to those who act as receivers of firearms over state lines. those fees are taxable.

If you act in a dealer regard, then charge tax on the rifle.
If you are merely a receiver, charge tax on the fee.


To the dealer who charges tax for the price of the rifle on person to person transfers, SHAME ON YOU:fire: . There is a store in Rockville Center (Donna at LI Outdoorsman) that does that and they get no business from me and my club as a result.

To the dealer who charges tax on ordering from a catalogue, that is a DAMNED questionable practice:scrutiny: . Only if YOU ORDER the firearm for the person can you claim the sale and charge tax. - as you are acting as a dealer, an arranger, etc. If the buyer arranges for the sale and you receive it, then there is a transfer fee and no tax to be collected on the price of the rifle:mad: .

HOWEVER, you can choose to deny such business, as most reputable gun stores do. I think it's fair to say, "if you want it from a catalogue, then you have to order it from me." That gives the dealer his mark-up profit. You can claim that you are a dealer for said catalogue exclusivly entitled to its business for your customers.

If you're stuck in long island with no decent FFL around, check out LRB Sales, came highly recommended to me, and i do so as well. flat fee, good guy.

And to the FFL who responded, you are free to do as you please, and you soujnd honorable and have written nothing false. We need dealers and FFL's on the boards for your kind of input. But recognize that most -9 out of 10 - in the stores in my area are highly disreputable and charge all kinds of taxes without ever sending them to the state. It's a mark-up on a mark-up,.
