NYC getting sued for collateral damage

until about 5-6 years ago NYPD needed to qualify once a year, now it's twice and believe me a huge majority are terrible shots, esp. with those horrible triggers!
 
What exactly happens to those that don't qualify? Does desperation for law enforcement over-ride any lack of abilities to do the job?
 
Eventually they will be "pencil whipped" In other words they will pass.
 
I know I saw a statistic that CCW's have better hit percentage than LEO in documented shootings.
We can't afford NOT to:
  1. We have no "qualified immunity".
  2. We have no union backing us up.
  3. We have no free legal representation.
  4. We have no presumption of both truthfulness and justification.
  5. We have no propaganda machine to defend us, no matter what we do.
If I shot three home invaders wielding MG42s, I would still be in a MUCH more precarious legal situation than the cops who shot that 71 year old woman twice in the back.

I could be wrong, but being able to meet state-level standards for weapons proficiency and continuing to demonstrate them periodically is a requirement for certification as a peace officer anywhere in the US.

Of course, desperate for bodies to fill out the ranks and/or a refusal to pay for training (bullets cost money, especially in an agency the size of NYPD) can lead to watering down the course of fire. I'm assuming that in New York, NYPD probably exerts an undue influence on New York state level law enforcement policies.
