Off duty Police told they can't carry at University

BS Federal law does trump state law.

Uh, read the Federal Law in question. It says:

This section shall not be construed to supersede or limit the laws of any State that -
(1) permit private persons or entities to prohibit or restrict the possession of concealed firearms on their property; or

(2) prohibit or restrict the possession of firearms on any State or local government property, installation, building, base, or park.

Kind of Ironic, they come out with the same arguments we do and have to face the same stupid arguments in response.

if i had it my way i would take it 10 steps forward.

1. When a cop is off duty they are a citizen and are subject to all applicable laws.

2. A cop is that is off duty id required to call 911 in case of an emergency just like everyone else.

3. A cop can only carry a wepon conceled with a ccw permit. Other wise are subject to open carry and all aplicable laws.


4. here is the best part. If the police officers do not like this then they should do something about it to allow private citizens the rights to bear arms as guaranteed by the 2nd amendment. Same time if an off duty police officer is envolved in a shooting they are subject to the same laws as a private citizen and must be taken into custody just like private citizens. their firearms must be relinquished until such determined then they must fill out 3 feet high of forms to get there gun back just like a private citizen.

and again if they dont like it then write to your congresman just like a private citizen
 
hotshot, 09-024 means it was the 24th opinion in the year 1999. The date underneath it was the exact date of the opinion.

Or are you just trolling now?
 
Actually the police in Nashville DO eat in restaurants that serve alcohol on their meal breaks. I have seen them many times, last Sunday for instance,
two marked cars from Belle Meade at Chef Yang off of White Bridge road.

During a house committee meeting last session over the proposed TN restaurant carry bill, one of the Republican house members brought the issue up of armed officers eating in establishments serving alcohol during their meal break. A high ranking officer from Nashville there to oppose the carry bill told him that officers were ON DUTY during their meal break and therefore not breaking any laws. His answer was not contested by anyone in the room.

I wonder though if being ON DUTY in an establishment for a meal break NOT for any enforcement reason meets the requirement of official duty. But we will never know, cause who is going to arrest them??

They were in fact breaking the law, however, as noted, nobody enforces it. They can ONLY be in there when there for work, not because they are on a break from work. See the AG ops a few posts up.

Personally, if I ever catch a local cop doing it, I plan to take a picture, and do everything I can to get him indicted for carrying. The cops stood out strongly opposing our restaurant bills, so I say make them suffer under the laws too.
 
im not advocating special treatment for law enforcement.. but think about it this way... if you make their job miserable, who will do that job when no one wants to anymore?
 
hotshot, I think we could live without cops just fine. Think about it, no cops means all the stupid laws don't get enforced.

Besides, it is a pipe dream, there will always be someone who wants the ease of government work, the benefits, and the power cops hold. Your average cop will more than likely view this as one more excuse to hate civilians. Most cops around here already do, and that is in their words, not mine.
 
I dont think they can do that. President Bush signed a bill several years back authorizing off duty officers to carry anywhere in the US. I would think this applies to police officers both retired and serving. I would carry anyway. Screw their policy.
 
what bout the not stupid laws... what about investigating crimes and solving them? the largest benefit of police is that its a group of people that pool resources to solve crimes and hopefully prevent them to say that we don't need them is pure garbage..... if you look at history in all societies, they all have a form of police... why? necessity....

ps if cops hated being cops so much why not just not be a cop....

Thanks for finding the AG opinion. It answers the question about the legality of MTSU's position. But if you reread my post, note the law enforcement position is that they ARE ON DUTY during meal breaks. The AG opinion is about OFF DUTY officers. I found it interesting that the house subcommittee allowed a Metro officer to answer for the entire state on what the mealtime policy was!

Nashville's Chief Serpas did have two detectives arrested while OFF DUTY in a bar a few years back for carrying. They acknowleged they were armed but blew off the manager when they were asked to leave - I believe they were drinking at the time. The manager called the police.

I did read your post. However, they are not discharging their duties, they are in fact taking a break from their duties. No exception in the law for them, of course, while uniformed there is zero chance they will be arrested for it.

Oh, and as for finding that AG OP, the moment this thread started I had it ready, because I knew he (or someone else) would want a lawyers opinion, in the hopes of shutting me down. Problem is, I know TN laws and regs on guns. I was a bit ready.
 
SomeKid, you and I are in agreement. I am only passing on the "official" postition.

Back to the Original Intent of my post. What LE is saying here is we don't agree with the law, we have been breaking the law, and we want to continue to break the law because we find it inconvenient.

Can I use that logic if caught carrying in Logan's while in possesion of a TN HCP while drinking my non-alcholic lemonade?

Lastly, the newscast refers to the President of MTSU possibly granting officers the right to ignore the law???? What's with that?
 
GOOD off duty they are citizens and if i cant carry then they cant carry. thats the bottom line.
Gee, and I thought everyone here wanted to promote the right to keep and bear arms ... this sort of hypocritical statement, in this forum, rather alarms me, because it should seem apparent to most thoughtful folks that if you want everyone to be okay with law enforcement officers being restricted from bearing arms, then heaven help the future of RKBA for ordinary non-LE citizens ...

By the way, proper punctuation makes more easily understood the meaning of one's written words ... but I digress, it's obvious that any thread even peripherally dealing with law enforcement will quickly bring out the vindictiveness of many here towards all those in law enforcement. Legally, he cannot. Were I a student there, I might be tempted to point out the applicable facts just to de-rail any chance the cops had. I might still e-mail him and let him know.

I look back and kick myself though. I have seen cops come in from all over the state, and even outside Tennessee for college courses, in cops cars and equipment. I wish I had pressed the issue and gotten some of them arrested.

Old Dog, maybe you aren't familiar with TN gun laws, but cop organizations have been attacking us for years, and slowing down RTC. Making cops abide by the laws they had foisted on us is justice.
