It s in writing, and it is specific to SB Tactical's equipment. None the less, I think it's a significant reversal indicative of what's coming...I hope.

The letter is written to SB Tactical but it does not mention their product specifically but rather "stabilizing braces" in general. As I read it it's talking about all ATF approved arm braces, not just the ones from SBT.

I've read the original (2012), clarification (2015) and latest letters.
They still leave much to interpretation. They DO NOT clearly say YES you can use it as a shoulder stock on a pistol length AR. They still talk about intended use and intention.
 
I think they must really regret approving those braces in the first place. They don't really have a legal leg to stand on by saying you can't shoulder one, yet by admitting you can they're basically making a mockery out of the NFA. I wouldn't expect a clear ruling on this anytime soon.

Actually they do if they determine you repurposed the brace into a shoulder stock. You're now holding a "un-stamped" SBR.

I'd rather have a true clarification then go on internet interpretation. I guess if you're wrong it's only a felony.
I guess I look at things differently now since my younger brothers screw up. Fairly minor in the big picture but they hung a Class C felony on him. Bad lawyer convinced him not to go to trial (all hearsay evidence).
Ended up sending all his guns to auction.
 
It appears at my first reading that if you take off the strap and lock the brace at an extended length of pull then your intent is to use it as a shoulder stock contrary to law.

In that regard the ATF did at one time allow stocks on pistols pinned at the shortest length of pull of which there are pics and posts in forums of the day. They reversed that decision and said no more stocks.

The one consistency is - they can reverse their decision. Other than that it's still pie in the sky if you can a brace as a stock. What they do appear to be saying is that they aren't going to waste their time going after perpetrators. I suspect the anti gunners and Range Nazis might be continuing to fill their email boxes with complaints - this should allow them to simply dump them and not reply.

They do have more important things to do.
 
I've always held that the previous ruling was in response to a unsophisticated question that clumsily stated intent in the question and was not intended to be general.

This new language makes sense:
If, however, the shooter/possessor takes affirmative steps to configure the device for use as a shoulder-stock—for example, configuring the brace so as to permanently affix it to the end of a buffer tube, (thereby creating a length that has no other purpose than to facilitate its use as a stock), removing the arm-strap, or otherwise undermining its ability to be used as a brace — and then in fact shoots the firearm from the shoulder using the accessory as a shoulder stock, that person has objectively "redesigned" the firearm for purposes of the NFA. This conclusion is not based upon the mere fact that the firearm was fired from the shoulder at some point.

So find your straps and it better not reach past your forearm :)

So how long does the SB Tactical SBPTW adjust to and is comfortable for "sporadic or incidental" shouldering?
