My brother was killed in Afghanistan several years ago. He was living in Missouri and served in an Army National Guard unit. Everything was left to my parents when he was killed. He had several shotguns and rifles in his gun cabinet. My dad has offered them to me so how can I legally take ownership of them. I live in Illinois and have my foid card. Is there anything special I need to know? What if I'd like to trade or sell them? Thanks.
 
Where does your Dad live? In Illinois or Missouri?

If your dad lives in Missouri and you live in Illinois, everything must go through a FFL. And you have the one day waiting period for rifles and three day waiting period for the pistols.

Call IL state police and ask. They will tell you the process necessary. That's their job to know, they oversee FOID and transfers etc.

My condolences regarding your brother. Take care and follow up so others who find this thread know the process.

Where do your folks live? If he's in IL then you're residents of the same state and it shouldn't be an issue (but if any state has odd rules it would be IL). If he's in MO then my best guess is you need to go through an FFL.

Condolences for your brother. I'm air force, currently in AR. I recently bought a couple of lowers online and found a pawnshop to do the transfer. If you go that route, spend 15 minutes shopping around-the FFL doesn't have to be expensive.
 
I would suggest contacting a local FFL holder with a list of your brothers guns and ask them if there are any restrictions.

After knowing that you can either:

Go to MO and get them and bring them back with you

OR

Have your parents ship them to you and have the local FFL do the transfer.
 
I could be wrong, but I don't think you can take possession at all. MO FFL ships to IL FFL who then turns your guns over to you after 4473s and waiting period if required.

Sounds like your Dad is the current owner, assuming he has possession of the guns.

If your Dad lives in IL you can do a person-to-person transfer as spelled out in the ILSP guide: http://www.isp.state.il.us/docs/9-049.pdf

If you Dad lives in any other state, you'll have to do a transfer through your local gun dealer. This isn't that big a deal, and they do this sort of thing all the time. The most important thing is to go talk to them first and see how they want to handle it. Your Dad can ship the firearms to them and they'll take care of the transfer and waiting periods.

In addition for a private transfer in IL to take place, there is the new 'do it yourself' online background check for the seller: http://www.isp.state.il.us/foid/foidp2p.cfm
(I didn't see this noted in the form Sam1911 provided a link to). This was added to the process as described last year.

Sorry for your loss. Firearms make a great heirloom and keepsake.

Don't stress too much--all normal non-NFA firearms are A-OK in Illinois with just a FOID. To my knowledge, Kane Co. has no unusual gun laws to trip you up.

Also, the responsibility for record keeping is on the seller and not the buyer. Not in any way advising that you take any shortcuts, you really won't need to, but you're not likely to be questioned about where they came from. It is common to have firearms from a deceased relative's estate. If your Dad is in IL, a receipt from him should be more than enough.
 
Dad in Missouri. You are in Illinois. Safest way to do it without. legal problems is to have dad's FFL in Missouri transfer to your FFL in Illinois. Illinois FFL does paperwork and does transfer to you. There are other ways that may or may not be perfectly legal and you may have no problem with but there is no way to get in trouble going FFL to FFL. I am an Illinois resident and familiar with out crazy laws. Once they are in your possession you can keep them, sell or trade them as you wish.

Your dad can take the firearms and go to a willing MO FFL for transfer to you. You will fill out form 4473 and have background check done by MO FFL dealer. The MO dealer will probably charge you a transfer fee which you can arrange beforehand. Once you clear the background check and after waiting the required IL period for long guns you may then take them with you to IL.
Introduce a handgun and it will have to go through a FFL in your state of residence.
 
So your dad is in legal possession of them in Missouri now, and you live in IL. Simple -- have him send or bring them to an IL FFL and do the transfer -- same as a gift. No mystery to it. Maybe find one that will give a bulk discount if there are a lot of them.
 
I live in your area and have been doing out of state transfers for a number of years now. I use MCS firearms in Lake in the Hills, probably 15 mins from you.
He's home based and runs 7 days a week, has a big following. It's gonna cost you some to have a Missouri FFL handle the deal at your pops end and you pay at this end for the bgc and transfer. Get the serial #'s and call Paul, 2 trips to get it done. All legal and your covered.
