I have to disagree with one thing said here: 30.06 should NOT be dismantled. A store owner should have the right to ban firearms in his or her establishment. Of course, that person or persons must also be held accountable for anything bad that happens in their store (ie shootings) while customers (ie guests) are in it.


I totally disagree. 30.06 needs to go bye-bye. While I support property rights, I don’t think that a business’s policies need to be enforced by law. You can break any of the company’s other “policies” without committing a crime. Why should carrying a concealed weapon be any different? You are not going to be arrested simply for walking barefoot into a store with a “shoes required” sign.

I agree, to a point. A business owner should be able to ban any object they want from their business. However, we shouldn't single out firearms as something deserving special legal recognition. When you go to the movies, they don't want you bringing in outside food, and the theater might eject you if they find out you've brought some. It should be the same thing with guns. There shouldn't be any prior restraint, but if the business somehow finds out you're carrying, then they're free to tell you to leave. It's like this in a lot of other states and I'd like to see Texas repeal 30.06 and return to this method.
 
I would like 30.06 to be broadened, in a way... any building not allowing guns must have that ordinance posted on all entrances. I like the fact that you've got a detailed way to keep people carrying out of your store - and that sign's the only sign that can do it.

If Gov. Perry wants to give TX college students CC, like the Utah folks did, I'm all for it. Next session, somebody needs to get open carry passed.
 
Up until this one issue, Perry has been a mediocre Governor, sort of like George W. Bush the second, getting by on Hollywood looks and personality.

Hey, I voted for Bush twice for President, not because he was so good, but only because the alternative was so much worse.

Off-topic: my ideal ticket for the 2008 election: Ron Paul and Condi Rice.
 
Ironic that he's telling this to Mike Leavitt.

Because Leavitt was one of the chief obstacles to getting CCW in schools here in Utah when he was governor. If it wasn't for our Attorney General, then state employees would still have been forbidden to carry at work.

I saw a sign that forbade firearms and was posted by the Texas Alcohol Commission, I believe, dont hold me to that. Point is there was no 30.06 sign. Are they legal? Carry any weight?
 
I agree with Lynn on his assessment of Perry. He gets too much support from backdoor deals.

But Condi Rice? What in the world has she done? She's just a puppet figure for Dubya. I can't wait for her to be out of public office.

Exactly right. If a company doesn't want you to carry and finds out that you are, they should only be able to ask the person to leave before the police arrest him for trespassing. We don't need the 30.06 garbage.

makarova, I think any business that makes 51%+ of its revenue from alcohol is automatically a place you cannot carry; it doesn't need 30.06 signs.

There are two signs relating to carry in establishments that sell/serve alcohol.

One is the "51% sign" which places that get the majority of their revenue from sales of alcohol are supposed to post. It is illegal for someone with a CHL to carry there.

The other sign outlaws "unlicensed possession" and is supposed to be posted anywhere that alcoholic beverages are sold that does not come under the 51% rule. This includes grocery stores and restaurants. These signs mean nothing to the CHL holder, but if someone is carrying without a CHL then the penalty in those places is a felony rather than the usual misdemeanor.

This is exactly the kind of logic and thoughtful argument legislators need to put forth to the public.

Licensed gun carriers in this state endure far too many restrictions on our right to self defense outside the home. My life doesn't become less valuable or deserving of protection just because I have chosen to attend a college class or a church service. The police can't protect me from someone who is about to commit a crime, they can only act once it is unfolding or complete. I am unable in all but the slimmest of circumstances to summon an officer in time to protect me from a person intent on doing me harm. I have chosen to bear the responsibilty of my immediate protection myself.

I implore you to push this line of thinking towards actual law. The legislature cannot protect the citizenry from criminals, they can, however, allow the citizens to protect themselves. Texans who have undergone background checks, training in law and safe use of a firearm and who have spent the time, energy and money to become licensed are not the problem here. I think, given enough of us, we might be part of the solution.

Exactly right. And also be required to provide secure facilities for visitors to store their weapons in while visiting the premises. The law should clearly state that the owners of the premises are strictly liable for any injury to all patrons that could possibly have been prevented by any patron having a concealed weapon. :cool:

This is absolutely true. I saw several of the morning shows doing the :rolleyes: this morning while relaying the news. We need to let Gov. Perry know that he is on the right track with this, even if you don't agree with his other policies; because he will certainly be hearing from people who disagree.

I see gas stations/stores everywhere with the 30.06 sign. Don't these people know they are the number #1 target for armed robbery? This is a real pain if you carry and travel a lot.
 
Without hand guns most of us cannot kill, certainly not at a distance. Let’s stop hand guns.

I am a 21 year veteran of the Chicago Police Department with a son at UT, and I own a condo in Austin. The argument that more guns reduce crime is flawed and very dangerous for law enforcement.

So less guns have reduced crime in Chicago?

Gun should only be allowed at home for protection or hunting Thats IT!! If all the public carries, you have to watch your back all the time! Get a brain folks!

The issue with Perry is he says what he knows will work for him and does darn little. I like him well enough okay but he was supposed to be doing something about illegal immigration, not giving illegal immigrants in-state tuition at the Texas colleges. :banghead:

Still, like most of the past TX governors he talks a good game.
