Pistol sale question...Massachusetts and general laws help!

Ok this question might get complicated, but here is the first part.

The Facts

1. I am a resident of Massachuetts
2. I have a MA license to carry class A
3. I have a non resident New Hampshire, Penn and soon FLorida permits
4. I live in Alabama and go to school in alabama
5. my non resdient permits let me carry in alabama


Heres the question, If my friend from mississippi has a pistol that I want to buy, can I just buy it from him since its a private sale? I dont have to send it back or anything since I am not going back to massachusetts any time soon.

Heres the other part of the question primarily for massachuetts people. Sine the pistol will not be MA compliant, and I dont plan on bringing back to MA because I will eventally move somewhere else in the south, are there any problems with that? thanks for the help

Well, if the sale is legal under Alabama law, then the sale should be no problem. You can check with local Alabama authorities on this. However if your friend does not live in Alabama, OR go to school there, you may have a problem. Again, check with the local people.

Nope, should not be a problem. BTW, even if a pistol is not MA compliant, IIRC a person moving here with such a pistol is okay since it was previously owned by them. MA GOAL ( www.goal.org ) should be able to help clarify this.

In your specific case this might be a problem. You are still a Massachusetts resident so that has to be factored in. Theoretically as a Mass LTC holder all of your (Massachusetts) firearms are listed with the CHSB. If you show up with a new pistol not "registered" with the state, you may have a problem.

A person moving to Massachusetts from another state is normally allowed to bring in their firearms in.

Again, go to GOAL's website and look for a reference for a lawyer who specializes in firearms law here.
 
thanks for the help, I am not moving back the cape where I am from. I will probally be in atlanta since I can actually buy a house there. The no restictions on guns is a huge plus too. thanks for the help!

The answer is no.

It's simple. You can only buy handguns within the state that you reside in. That's federal law. The licenses you have don't change anything. If your official state of residence is Mass...that's the only place you can buy handguns.

That means that even if you were a resident of Alabama, you could not purchase the pistol from a resident of Mississippi, as a private sale.

You can buy the gun but you would have to take possession of it from an FFL in Mass.
 
I hate to tell ya, but I'm pretty sure your MA LTC in null and void due to your address change- unless you notified ze proper authorities about your address change within 30 days, your LTC/FID becomes inactive. I betcha that if they knew that your new residence address was aou of state, they'd hit you with the $100 per year out of state LTC.

Probably not. If he's a bona fide student, his legal residence can remain his parent's address in his home state as long as he's enrolled as a full-time student.

Once he graduates, all bets are off. Then it's decision time.
 
I am not a resident of alabama and I am a full time student. My Ma permit still stands because I have not changed residents. Also I am very glad to be moving out of ma since it suks to own guns there.
