RANT: Buying a gun as permanent resident

I’m not an alien but my DL and CHL do not indicate that I’m a natural born citizen or a naturalized citizen.

All I do is show my DL and CHL and that’s it. Hand over the money and here’s the gun. Well, it does get called in, but no hassle on that.

If Kangspec has a DL and a CHL (or CCW, or whatever it’s called in wherever it is) I must be missing something about why there’s a problem.

Block 3 on the Form 4473 asks for "Place of Birth: US City & State OR Foreign Country". Questions 11L and 12 also determine whether the purchaser is a US citizen or not. If the purchaser is not a citizen then blocks 20c and 20d must be filled out, and that's where the OP got hung up.
 
I find it interesting that the FFL holder got four different answers from four different calls to the FBI. You have to wonder whether he was dialing four different numbers each time, or whether we now have four different FBIs operating on our shores? It's not the first time we've heard this sort of report regarding officialdom -- and it most won't be the last, either -- but it is more than a bit annoying that the guys who are supposed to be in charge and in the know can't seem to get on the same page at the same time, let along the same day.
 
IMO you blokes who have to put up with that sort of stuff--imagine a semi-literate retail clerk "approving" anyones's exercising a constitutional right!--ought to consider moving to Virginai.

Until Virginia secedes it won't help much since the issue is a federal requirement when purchasing from FFLs. Some states have additional requirements, but the 90 days of proof of residency is a BATFE requirement.
 
Sorry you had so much trouble. Non-citizens buying guns is fairly rare (I'd have to check but it is about 1 out of 500 that I sell) so a lot of places aren't too quick on it.

Owner called the FBI asked them is my bank statement okay? they said "NO" ***?

I'm sure he was just trying to cover his ass, but why even make that call.

The 4473 specifically states "utility bills, current bank statements, rent receipts, mortgage payment5s, lease agreements, personal property tax bills, documents issued by Federal, State, or local government agencies, first class mail issued by a government agency, insurance policy, or bill with current address or major credit card bill."
 
If you have to use a bank statement or something with private information, ask the salesperson to cover some of the numbers when they make a copy, I always use my checkbook as my second form of ID and have never had any issues with the request. They copy the forms of ID at the same time so it just takes a little care in the placement of the IDs.
 
please correct me, if i'm mistaken. this only applies to BUYING a firearm, right? my wife is a permanent resident and her packet said she could own firearms. there's no problem with me just giving her one, right? and she'd just be held to the same carry laws as the rest of us Floridians, right? the proof of 90 day residency is just for purchasing?

Check with Florida state law but in Alabama a private sale does not require background checks or immigration clearance. Those only apply to dealer purchases.
 
Okay then i dont know what to bring for proof that i was here more than 90days. (DL not work, Alien card no work(*** why?) it had to be non-picture nor state issue)

As already stated, does your DL not have a DATE ISSUED on it? I thought it was pretty standard.
 
UP TO 2009 YOU REQUIRED TWO DOCUMENTS OF 90 DAY DURATION, YOU NOW ONLY REQUIRE 1.

I take 4 preceding months of Hydro bills, shows my name, and address.

Because I have a G lic, I pay the same price that Police pay, plus an extra Magazine, 3 instead of two.

The form asks for place of birth, which is England. Because of CCW permit there is no waiting period, The longest I have waited is an hour.

One day while waiting, an American born chap came in to buy a pistol, he said he had renounced his Citizenship? I cannot wait to get mine, I will buy a Cowboy hat then!

Oh, and no they would not sell him a gun.

Giving your Wife a gun is OK, going to buy it for her? Is not OK, that constitutes a straw sale and is illegal.

In Florida, God.s State (Cold just now!!) You can buy a pistol off a friend no need to tell anyone, I personally would only buy from a friend, or sell too one.
 
Bank statements will work, just blackout info like account numbers and balances.

Also, keep your green card with your license and other stuff in your wallet. Technically, you must have it with you at all times. You can be detained and transported to a holding area until your status is verified.

Good advice about carrying at least a copy of the "green" card.

I had a lot of fun at a checkpoint for not having my GC with me.

Got a friend that lives south of San Antonio.

I told them the check out my border crossings (I had several due working for a tour company) and the last one was one week before the incident.

Never leave without it.

Ever again.
 
I was so used to carrying a green card with me all the time, that it made me kind of twitchy when I handed it back when I got my citizenship.

I carry a Passport Card now. Wouldn't want to be mistaken for one of those illegal Canadians.

LOL, well this geordie got his in about 13 months, and I used to carry my PR card in my wallet too. That time included the ceremony and such like, I was approved in a year almost to the day. I'm married to an American so I only had a 3 year wait, 2 to come off conditional GC and 1 more for naturalization. I have no clue how long you need permanent residency if it's not through family.

There is a reason the police don't also serve as your jury/judge. Having police officers get points of the law wrong, particularly when it comes to guns, is more the norm that the exception. Put five of them in a room, ask the same legal question and you are MUCH more likely to get 6 answers than one.

Mine took about 6 months even with paperwork issues in the end. I had been here 10 years and married so really it wasn't an issue on that side, i exceeded the married requirement and the residency requirement.

Now is a good time to do it because they aren't busy, the increase in fees to over $675 cut demand in half.

Now I get to do the 4473 and leave off my A number, and when tested the other day i get instant proceeds.

Buddy of mine (canadian resident Argentine) was passing through new mexico.

He stopped at the shop and left his bike to ride with me in the car.

I was getting ready to go at the office and pick up my stuff, including openly carrying my glock .40.

He looked at me like I had two heads. "Is that a gun?" :what:

"No, it's a can opener. Don't worry, it's legal here in this state" :D

When we got home he got pictures taken with my guns ... :D
 
My brother was telling me how my uncle has this cool AK47 in the UK, its neat and you can cycle it etc and its a real one blah blah... so i tell him to hold on and a few minutes later he hears this loud bang.... alarmed he asked what that was, just to have me answer that it was MY AK47 :)
