Remington R-15 in NY State

Today I walked in the local Dicks where I saw Rem R-15 and R-25, don't they fall under assault riffles and should be banned? Or something changed with the laws and I didn't catch it, last time I checked NY State term for assault weapon is next:
A semiautomatic rifle that has an ability to accept a detachable magazine and has at least two of the following characteristics:

* a folding or telescoping stock
* a pistol grip that protrudes conspicuously beneath the actionof the weapon
* a bayonet mount
* a flash suppressor or threaded barrel designed to accommodate a flash suppressor
* a grenade launcher

* Any of the weapons, or functioning frames or receivers of such weapons, or copies or duplicates of such weapons, in any caliber, known as:
o Norinco, Mitchell, and Poly Technologies Avtomat Kalashnikovs (All Models)
o Action Arms Israeli Military Industries UZI and Galil
o Beretta Ar70 (SC-70)
o Colt AR-15
o Fabrique National FN/FAL, FN/LAR, and FNC
o SWD M-10, M-11, M-11/9, and M-12
o Steyr AUG
o INTRATEC TEC-9, TEC-DC9 and TEC-22
o revolving cylinder shotguns, such as (or similar to) the Street Sweeper and Striker


So is it safe to get one in NY State?
 
it does have pistol grip and that just one feature, but its based on AR platform...
 
I wonder if the piston system gets them any leeway with the law as written?
 
I bought Saiga once I had no problem with law, its based on AK platform but has nothing what would make it an "Assault Weapon"... Does anyone know what's the right AR's in NY State, buying post 94 compliant AR would make it OK or the Remington R-15?
 
The Remington R-15, Bushmaster XM-15, etc. are not "copies or duplicates" of the original Colt AR-15 (which is just a trademarked name owned by Colt, anyway). Basically, the name "Colt AR-15" is banned, and that's it, which was the case under the 1994 Federal non-ban and is AFAIK the case in NY.
 
In NY, you have to pin the stock if it's adjustable and pin and weld a brake in lou of a flash hider.

Remember to remove the bayo lug as well... the features you are ALLOWED is the pistol grip and the removable magazine.
 
Also, a surprising number of reasonably priced pre-ban AR mags are in the state.

I picked up 6 pre-ban 30 round AR mags for $40 shipped from a seller in Texas via Gunbroker. After a good scrubbing and the upgrade to wolff +5% springs and magpul 3rd gen followers ($40 for all), these pre ban mags are better than new! Once you have the pre-ban mag body, keeping the mags 100% functional is very easy.

Does anyone know what's the right AR's in NY State

I picked up a RRA national match lower with 2 stage trigger and then went with a Del-ton 20" custom upper. Del-ton also has a nice batch of post ban compliant 16" and 20" uppers pre made (so to speak) so all of the guess work is taken out of the equation on your end. I wanted a 20 government profile barrel so I had to go the custom route with them... so YMMV!

There are couple things you need to do on any post ban upper to make it NY legal:
- order a comp/brake pinned and welded OR order an un-threaded barrel. I ordered my barrel threaded and then had a local smith weld on a Jerry Miculek Muzzle Brake or you can just order a Phantom Aggressive End Comp/Brake pinned and welded from Del-ton.
- Remember to order your Gas Block with an A2 Front Sight with No Bayonet Lug

The R-15 with the non collapsible stock is totally legal in NY (I know since I bought one from Dicks last year).
Any AR is legal in NY State (not in the city) as long as it does not have a flash hider (but you can have a Muzzle Brake that has been permanently pinned and welded), a bayonet mount, or a Collapsible stock (unless it's permanently pinned in place) and has a minimum barrel length of 16 inches. Also keep in mind that the maximum mag capacity in NY is 10 rounds (Unless the mags and upper & lower are pre bans,).
 
Thank you all, I think I will get one just have to decide which one, but first will have to get rid of some of my bolt action rifles which I don't use. By the way will this be legal?

I understand the scary features that are listed, but how is my Armalite lower with my White Oak NM upper not "a functioning frame or receiver of such weapons, or copy or duplicate of such weapon" as the AR-15. I'd say the upper and lower receivers are pretty close copies.......no? Aside from the whole law being ridiculous, that's the only part that my AR might run into trouble with.
