Robber held at gunpoint until police arrive

FLINT (WJRT) - (06/05/06)--A man is behind bars after breaking into a Flint home. Monday afternoon police credited the homeowner for helping them catch the would-be burglar.

It all happened Monday morning at a home in the 5600 Block of Fleming Road north of Pierson Road on Flint's north side.

It all happened early Monday when the man living at the home pulled a gun on the guy. It started when the man living there told police he heard someone trying to break in the back of his home.

The guy got in a basement window and made his way upstairs. But not before waking up the man sleeping inside the house. He grabbed a gun and confronted the burglar face to face.

He held the would-be burglar for 10 minutes, forcing the man to lie on his belly while he called 911. Police showed up and quickly arrested the man.

Neighbors living nearby say they saw the would-be burglar but didn't think of it as suspicious until police showed up.

No one was hurt in all of this. At last check the man arrested is in jail.

The TV anchor said the Home owner will not be charged.
My thought why would we even have to say that it should be the default thought.

People here tend to get suspicious when they see a stranger crawling in a basement window. We're funny that way.
 
The very first "stranger than fiction" incidents that I saw in my 31 years in law enforcement took place just a few days after being assigned to a patrol division after graduating from the police academy, back in 1971.

The radio call was "Citizen holding a robbery suspect". When my partner and I arrived at the scene, a rather bulky man was laying prone on top of a smaller man. There was blood all over the place, so we knew that something violent had taken place. After cautiously approaching, we pulled both men to their feet, and a .45 auto pistol clunked onto the sidewalk. I retrieved it, then we went about figuring out what had happened....only, we had to call for an ambulance. The man on top turned out to be the victim of a street robbery, and he had been shot a total of 5 times in the chest! There were several witnesses that verified what had happened, and the handcuffs went on the suspect.

The wounded victim passed out just before the ambulance/paramedics arrived. Fortunately, the E/R was only a couple of blocks away. It was "touch and go" for several days, but the victim DID recover....and testified in court! Four of the 5 rounds were removed, but the 5th round had been a through-and-through. NO vital organs had been hit!

When the victim took the witness stand, he related that the suspect had walked up to him, produced the pistol, and demanded his wallet. The victim stated that he tried to disarm the suspect, but during the scuffle, the pistol went off. The victim said that he knew that he had been hit, but he still had enough strength to overpower the suspect by tackling him, then laying on top of him. You could have heard a pin drop in court when the victim stated, "I didn't want that guy to get away!"

"Helping them catch"? How about "apprehending," which is what he did all by himself?

Since when is 10 minutes response considered "quick"? I's hate to have to rely on them to actually come and handle anything going on.

Oh, right. Silly me. That "Serve and Protect" stuff is just PR - we are responsible for our own safety.

"At last check" -- does this mean he might be bonded out, or is there something we ought to know about the security of the local jail?

I've always turned such a scenario over in my mind and I've figured out what I'd do, tactically speaking, to detain the bad guy if I had to simply under the premise that if I don't I'll either have to shoot him (and get in trouble) or he'll run away and go try to victimize somebody else.

But what I've never been able to determine is just how much hot water I'd get into for doing it. Something along the lines of "unlawful detention" or something if the burglar has a weasely attorney.

Here's a thought: Is there a compendium of the various states' citizen's arrest laws, like Packing.org complies all of their concealed carry laws? That could be a useful thing to have around.
 
I applaud the homeowner's restraint, although I'm not sure it was the safest choice.

The report, if we fairly call it that, doesn't say whether or not there were any other residents at home when it happened. Perhaps he was the only one there and was therfore only risking his own life.

What about those of us with spouses and/or children?
If we attempt to handle a break-in thusly we are risking not only our own lives but those of our loved ones.

Anyone notice that this happened in Micheal Moore's home town? If Moore had his way the home owner would have been unarmed or would have had his gun locked up so tight it would have taken him 20 minutes to get to it.

It's really is too bad it wasn't Micheal Moore's house the criminal broke into. :evil:

If you're speaking of trying to wrap the bad guy up in duct tape .... that's one of the best ways in the world to get yourself killed dead as a burnt boot!

Do not EVER put yourself in the bad guy's kill zone, intentionally! Many criminals not only know how to disarm you, they practice it.

Even experienced cops know just how dangerous it is to handcuff a suspect.

Stay away from the bad guy!

So is it legal to shoot the guy in your home in North Carolina? If so, that kind of answers the tactical question on home invasion.
 
So if you live in NC and some burgular breaks into your home, what do they expect you to do, you have to open the door and escort them out??? That's stupid.
I know that in Ohio we have no stand your ground laws and in fact we have a "duty to flee" (except in the home) which means that lethal force is supposed to be the last resort... but this NC law takes the cake!
