Selling a C&R

I have a question. I of course know I cannot sell a C&R to another person for the sake of making a profit. As a licensed collector, I can only sell to better my collection. I have this confirmed by the ATF.

My question is, if I decide I want to sell one out of my collection, that is recorded into my bound book, do I have to do a form 4473 on the buyer?
 
all you have to do is record the sale in your bound book, unless its a handgun in which case you have to provide written notificaiton as specified in ATF I 5300.2, Youth Handgun Safety Act Notice (unless selling to another C&R or other FFL licensee) and if you sell multiple handguns to one person (more then one in a 5 day period) you have to prepare an ATF Form 3310.4 (again, unless selling to another C&R or other FFL licensee)


Oddly enough I just got my annual letter from the BATFE to C&R holders that restates all the rules. (so I'm quoting from that)

The way you phrased that is bugging me. You aren't allowed to use your C&R FFL in order to be "in the business." So buying 10 K31's and selling nine of them is iffy. (Selling all ten would sure be a problem.) Maybe you could do it once because you _really_ wanted one really nice one. But if you do it over and over again and you take out ads or attend gunshows to sell them, you are probably going to get yourself in trouble. We all understand that.

But there is nothing that says I can't occasionally sell a gun "for profit." I've got a Rock Ola M1 Carbine. I've had it for a couple years. If someone comes over to my house and offers me $500 more than I paid for it, I would be tempted to sell it. I would certainly be under no legal obligation to turn them down because "I would make a profit." Selling a gun here and there in order to buy some other gun you want more is just part of being a collector.

Making a living by selling guns is a whole 'nuther thing!

(I say all this but I've never sold one of my C&R guns yet. But that's just because they are each unique in their own way and I would hate to do it. I CAN sell them if I want to do so.)
