Selling Across State Lines to FFL

Is it legal for me to sell across state lines to an FFL? I believe it is, just want to verify before I commit a federal offense.

Edit: I am selling a handgun.

I believe as long as they're long guns, and there are no more restrictive state laws in either state you'd be fine. I believe hand guns must be from FFL to FFL if sold across state lines I'll try to dig up the specific rule on that.
 
Q: To whom may an unlicensed person transfer firearms under the GCA?
A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.

From the ATF's website doesn't specify long guns and handguns, so I would say you're good as long as there are no wacky state or local laws to tie you up.

I guess the handgun thing is for unlicensed buyers.

Background check

Does an internet sale, shipped across state lines and therefore received by an FFL generate a background check?

I keep hearing on the news about gun show and internet loopholes but I have never seen the loopholes in action. When I ask about shipping guns at my local dealer they always say you must have them shipped to an FFL. Wouldn't that FFL be responsible for a background check?

The loophole doesn't exist. What drives the anti's nuts is that under current federal law, a non-FFL can sell privately to another non-FFL as long as both reside in the same state. Some states restrict private transactions, but most do not.

That has been driving me insane. I see it posted everywhere on news sites and in comments. I don't know how many times I have had to inform people how the process actually works.

Do we really WANT to correct them? Let them pass a law that requires background checks on internet sales by dealers to feel good, like they did something, when the law already requires that anyway. :evil: Just attach the word "loophole" to the new law and let them go for it.

As far as I can determine, the only way that an Internet "loophole" would occur is if I found a firearm on line and went to purcshase it in person.
No firearm can be shipped in Interstate Commerce UNLESS it is shipped to a FFL , THEREBY necessitating a Backround Check.
This legislation has been on the books for YEARS!
It IS irratating to find out just how ignorant of "Gun Laws" a good portion of our "Lawmakers" are!
