Shipping a ruger old army

Since a replica of an antique firearm is not a firearm per ATF, can I ship one USPS? Private party to private party.
As original, Ruger Old Army black powder pistol.

I would do signature required, and insured
 
Federally there is no requirements to ship it any particular way. You can send it by the post office unmarked directly to the buyer. Ive bought and sold a few over the years. If you do have a conversion cylinder it is a firearm and must go through a dealer state to state.

Check your state laws and the state laws of the recipient. Those matter as much as federal laws.
 
Last year I bought a replica 1860 Colt on Gunbroker. Came via US Mail with no problems, other than that it was shipped to my old address and had to be forwarded. :cool:

In Illinois, for example, a blackpowder revolver or rifle is considered a firearm by state law - actually, even a .22 pellet gun or a .177 air rifle/pistol that has a muzzle velocity above a certain speed is also.

So ... KNOW the applicable STATE LAWS !

Same thing for New Jersey, black powder pistols are considered handguns, black powder rifles are considered regular rifles. Same goes for pellet pistols and pellet rifles.

In New York it would not be considered a pistol unless you had the components on hand to make it fire. So no black powder and no caps.
 
It isn't a replica of anything.

It's just a modern cap & ball revolver, which isn't a 'firearm' under Federal law.
But it may be under State & local law.

I am not sure of the current ruling, but in MD when the Ruger first came out the state police ruled that since it was not a replica or copy of an antique, it was a modern firearm. How it loaded was not the question since the law defined an antique to include "a replica or copy" of an antique, not by ignition method or the powder used.

The Ruger Old Army is a replica of the Remington Model 1858, but with modern parts such as adjustable sights.
 
No, it isn't a replica of a Remington.

The basic shape is similar, but it isn't even close to being a replica of one.

The Ruger Old Army is 3 screw blackhawk that has been modified to fire black powder and use percussion caps. Thats all. Its not even close to being a replica of anything historic. Its still a non firearm by federal law.
 
I used fedex to ship my Ruger to Clements for the conversion and he used priority mail to ship it back. As he stated it isn't a modern firearm . As a FFL holder he should know
 
Ive had an FFL absolutely refuse to ship me a ROA unless he shipped it overnight at $55. I did my scouts best trying to explain to him that he didnt need to and I supplied him the USPS regs stating it wasnt considered a firearm and he could ship it however he wanted. Must have gone 20 rounds with him. He wouldnt ship it no matter what unless it was overnight . He was sure that he would lose his license for breaking the law by shipping it priority mail. He had logged it in his bound book for petes sake! I gave up after he told me that. Some people are their own worst enemy.
