Yeah, but you are better off knowing it could be brought up in court. Even though you aren't changing your plan, you will do better during a trial if you are aware of the possibility that the ammo choice can be used against you. That's why it's repeated so often. Even Ayoob doesn't say not to use HPs, he just says to be aware of the possibility that you will be singled out for it.

I completely agree.
I also think that the best way to keep defensive shootings out of court is to minimize the amount of drama, witnessed pissing matches, stupid public statements, and bloodlusty attitudes in your life. If you care enough about your safety to carry a gun to protect yourself, then you should also work to minimize the likelihood the D.A. will think you are a dirtbag if you ever have to use it. Not necessarily far, still true.
