Shotgun import ban question

I recently downloaded CDNN's catalog 2007/5 and was shocked to see that they stated that importation of hi capacity semi-auto shotguns was now banned; from further importation. It was listed on page 40 and displayed on the FN shotgun descriptions as well. Did I miss something here? A search on THR and the web found nothing. What's the deal???
 
922r has been in place since 1989- and yes, it applies to ALL shotguns as well as semi-auto rifles.
 
I don't understand. The shotguns in question were only made within the last year or so, and I assume imported. They were and still are available for purchase in CONUS. Why are they now banned? Can anyone elaborate on how 922r applies to the FN SLP shotgun?
 
Maybe it is CDNN hype? All import firearms must meet the sporting clause unless they are for .gov
 
Most likely, ATF decided they were not "Sporting" firearms and thus illegal for importation because of the 1968 Gun Control Act. The same reason they cannot import most HK rifles, AUGs, etc.

This is the most likely explanation. The ATF can arbitrarily decide what is or is not "sporting", with no oversight or accountability. So whats legal today may or may not be legal tomorrow... or vice versa. Its pretty ridiculous.
 
I don't how these guns are non sporting and is there something on the BATFE website?
 
Silence peon. Do as your government tells you and don't ask questions about why. We know better than you so we can tell you what is and isn't sporting.

Thats about all your gonna get out of them.
 
Similarly, as discussed in the "Background" section, the legislative history of the GCA indicates that the term sporting purposes narrowly refers to the traditional sports of hunting and organized competitive target shooting. There is nothing in the history to indicate that it was intended to recognize every conceivable type of activity or competition that might employ a firearm.

It's like the AK clones. You can import the low-cap sporitng models, but the hi-cap ones need the correct number of US compliance parts.

Somebody else said that this shotgun uses the same action as the Super X-2, which is only available in low-cap, hunting-looking, configurations. This is a hi-cap.

The Winchester Super X2 Practical comes from the factory with an extended magazine.

The FN SLP Mark I and the Winchester Super X2 Practical Mark I are the exact same shotgun. (the original SLP is basically an X2 practical with a shorter barrel and different sights).

The reason I pointed out that the FN shotties are built on Winchester actions is that I believe they are actually American made and therefore not effected by any import ban.
 
I also think that some if it has to do with the collapsable stocks on some FN and Benelli shotguns as being now considered unsporting. Not sure if factory pistol grips on shotguns are eventually going to fall into that category. Personally, w/o uproar I think they will. Take the reasonable inch...
 
Any gun with a bore of over .50 is a "destructive device" unless the ATF finds it has a "sporting purpose" so most shotguns are legal without the NFA mess but not all. There's also the matter of not being able to import a non-sporting shotgun or whatever...we really need to eliminate the whole "sporting purpose" clause wherever it exists in the laws...
 
The odd thing about considering counting parts is that the SLP only has an extended mag tube. It has no pistol grip, no collapsible stock, etc. It does have ghost ring sights, but I don't think that counts as a part. It's basically an 18" hi capacity "quail" gun; thats black and mean looking. I mean, thats what I bought mine for-quail hunting. :D

Where does it say shotguns with mags over 5 rounds are banned? Especially pump and lever action shotguns?

After searching, I don't know if pump shotguns with extended mags are banned from import or not. The only thing I could find was they are banned from "temporary" import into the united states. Semi-automatic shotguns with a mag capacity of greater than 5 are banned, I'm pretty sure... and the that is what the cdnn catalog was referring to.
 
Some people have posted that 922(r) only applies to semi-autos. The law says semiautomatic rifle or ANY shotgun. I can't find anywhere in 925(d)(3) which lists specifics, but it seems like it was carefully worded to included any shotguns.

(r) It shall be unlawful for any person to assemble from imported
parts any semiautomatic rifle or any shotgun which is identical to
any rifle or shotgun prohibited from importation under section
925(d)(3) of this chapter as not being particularly suitable for or
readily adaptable to sporting purposes except that this subsection
shall not apply to -
(1) the assembly of any such rifle or shotgun for sale or
distribution by a licensed manufacturer to the United States or
any department or agency thereof or to any State or any
department, agency, or political subdivision thereof; or
(2) the assembly of any such rifle or shotgun for the purposes
of testing or experimentation authorized by the Attorney General.
 
I can confirm that the Winchester SX2 and the FN SLP Mk 1 are EXACTLY the same gun as previously noted. I have an SLP and my friend has an SX2, we've compared them side by side and even broken them down.

However, the FN's being rebranded Winchesters is a little backwards. The Winchesters SX2s being rebranded FNs is closer to the truth.
 
So Darth, somewhere on both guns the nation of origin is stamped ... dl they say "Made in USA" anywhere on them?

The Winchester SX2 is made in Belgium and assembled in Portugal according to all literature I've ever seen on the guns.
