So - After the Shooting Stops - THEN What?

Most states have laws saying that you can use deadly force if you reasonably fear that you are in immediate danger. You don't need to see a weapon nor does your attacker have to be holding one to cause you to fear for your life. Ten guys beating on you? I'd fear that. I'm a fat old man in poor health. You think I'm going to fistfight some 19 year old stud? No way, Jose. I walk away from any argument and if he won't let me walk then I shoot his ass dead because he'd seriously injure or kill me in a fight. In Texas a couple years ago one guy was beating on another man in a case of road rage and the driver being attacked shot the attacker to death. He feared for his safety. Ruled justifiable.
 
It is appropriate to have the head mounted when the bad guy is a grizzly bear or a very large mountain lion.

Saving ones family from a maurauding raccoon does not warrant a trophy.
 
Based on just what you've posted, I'd say no. You haven't said why you feel threatened, other than that you're outnumbered and they're big guys. If they've made threatening comments or gestures, then you're more likely to be able to explain why you felt threatened.


Well lets put it like this. I have 10 guys around me. They are not armed but it is clear that neither me nor my girlfriend will be able to run away. I fear for her life, and I fear for mine. I try to get out of this circle, but they won't let me out. I continue to let them know that I "come in peace" (yea i know. sound like an alien right?), but they continue to disregard my statements. Then I try to flee but OBVIOUSLY I am surrounded. Since I am not Batman and can't take 6-9 guys down at one time, what do I do? Pull the black steel ninja?(.40 Walther P99) Or let them beat me?

You may ask. Well...they haven't attacked you yet so why the fuss?

Well I want to move along with my night and not have any trouble but they just won't let me out.

You may say: There is no threat to your life or great bodily harm

Fine!

One guy comes from behind and pulls me down to my knees with both my arms behind my back. Another guy starts to beat on me, while three others begin to sexually harass and molest my girlfriend.

I can somehow break free from the two guys, and push back enough distance to clear for good shots.

I would hammer those two sucks and quickly run to the other 3 to take them down with DEADLY FORCE.

Sorry for contributing to the thread drift-- we've departed from the original topic.

Your latest post contains more information that more clearly shows the threat, and in my non-lawyer opinion think you would be justified in shooting.

Your second post describing the scenario could also have been "The 10 guys are 50 feet away and sitting around a fire, but I'm scared of them because they're all big and have tattoos all over their bodies."

Or even "They're sitting down and yelling rude comments at us, but they're not making any threatening movements".

In either of these last two scenarios (that I describe), if you shot them you'll probably end up in jail.

Pulling a trigger on someone will make your life VERY complicated, VERY fast. You'd better know what's coming before it shows up unannounced.
 
Find yourself a good self-defense friendly criminal attorney now, before you need one. Ask around among friends and shooting related venues, it shouldn't be too hard to come up with a short list of names. Set up an appointment now, most initial consults are free and even if it's not, it is still a good investment. Talk about your attorney's views regarding what you need to do/say in the unlikely event you have to use your CCW, and go from there. Your attorney will likely want to be sure you know what you can/cannot and should/should not do regarding concealed carry and self defense, to make sure he or she isn't getting a cowboy for a client. If the two of you see pretty much eye to eye then you should be in good shape.

Then tuck one of your attorney's cards in your wallet right behind your permit.
