A St. Paul police officer cleared of using excessive force against a 12-year-old student at Ramsey Junior High last year is being sued by the boy and his legal guardian, the state Department of Human Services.
Police said Officer Tou Cha was trying to stop a fight involving the boy's sister on Dec. 9, 2002, when Prince Carl Butler Jr. jumped on the officer's back.
Investigators say Cha flipped the boy over his back and the boy hit his head on the floor. Cha stuck his foot out to keep the boy from striking his head on the floor, police said.
Attorney Richard Hechter, representing the boy, said Friday that his client disputes that account and that the boy never jumped on the officer as he was making an arrest.
The city is preparing a response to the suit, which seeks more than $100,000.

The "good" news about this BS lawsuit is that we get to pay for it... I hope that when it's over they pursue costs against the 'victims' guardian.
