Actually, it probably won't take as much time as you might think. The ATF will move fast if they think they have a "dirty" dealer to make sure he doesn't commit any more crimes. They take things like this VERY serious. Just check with honest FFL dealers who have been harassed by the ATF. They put you through the ringer even when they aren't sure there's any wrong doing there so I can only imagine what they do when they have a fairly good idea someone is doing wrong. Like I said above, this guy is in it deep!! (all his own doing too)
 
all day for $200 ?! *** ?! i'll take 50 at that price.

sometimes principle is worth more than the money. I'd be so fried after all this. i'd go to the end of the earth to see this cat suffer. and i'd probly spend more money than that gun was ever worth just to jerk with this guy. sorry but sometimes i really hold a grudge.

i hope your gun magically re-appears.

Hmmm, somehow I doubt (unfortunately) that is going to happen. This FFL is already going to be in pretty deep kimchee with any number of state/local/federal agencies that -really- don't know how to take a joke.

For that gun to "magically re-appear" would be a defacto admission of perjury/filing a false report, which would just add more misery to this fellows (well deserved) soon to be miserable life.
 
It appears from the evidence offered by others here that the $750 was a very fair - even overly generous - settlement offer.

I am passing on small claims and going for big boy court. I plan on making life for him a living hell.

One thing not mentioned here yet - and I almost hate to bring it up, but...

Although he brought this down on himself and deserves everything you, the court, and the ATF can dish out - he will still blame you for ruining his life.

In addition to your Python, he probably has your phone number and address.

If he so much as utters the mere hint of any kind of threat, call the police and ask for a protection order to get it on record.

This guy sounds like a real nut-job.

Sounds like a "win-win" situation to me (and too much to really hope for.) Guy needs to spend about 10 years in prison; doesn't really matter what specific charge they get to stick. And it would be nice if Hammer got his gun back out of the deal.
 
I'm willing to bet this isn't the first time something of value mysteriously walked out of his shop.
 
My attorney contacted a few dealers, and the conclusion she came up with is that a Python with a factory refinish assuming it has no other issues, retails for 1500.00. She is sending a demand letter for 1500.00 plus her fees(25% if out of court settlement), and if he does not accept, then it is court for 1500.00 plus appreciation of the gun since they told her Pythons appreciate over the years, her fees and court costs( 40% if we go to court). She read the police report and our statements and said it is a no brainer. He took it, "lost" it and is required to reimburse me for my loss according to the laws of the state. She told me I was stupid for trying to settle for 750.00. Since the gun was going for a factory refinish, I can include in the value what it would be when it came back minus fees for the refinish. I am glad I am a law abiding person and have never been sued. It will take a few months to go to court, but it is worth it. As soon as the paperwork is filed, (it becomes public record) I will let everyone know that if they deal with him, be very careful.

If you have dropped a dime to the BATFE on this guy, what your attny will be doing to him is the -least- of his worries.

I have to cheer you on too. Guys like that (fire arms dealers or not) need dealt with, HARSHLY. I hate dishonest people and even worse thieves. I had a couple grand worth of stuff stolen from me on different occasions, never saw any of it again (they even stole a bible with my name printed on it). I used to trust people, now I carry a gun. Take this guy out of commission. Drop the hammer on him Hammer!
 
Here is funny. Reading these posts at lunch when my cell phone rings. He left me a message that if I come by his shop today, he is ready to settle. Dollar short, and a day late. I signed a contract with my attorney yesterday and I can have no contact with him, it all goes through her. Keeps me from doing anything stupid. He should have settled before he tried pushing me around. Now he can deal with her.

Good. Stick it to this clown. It sounds as if you've been more than reasonable with him in the past and have given him every opportunity to make amends. He should of paid you the $750 you originally asked for and kissed your shoes. Let him kiss something else while he deals with the legal system.

Hopefully you will be able to collect more than the $750 - and you'll be doing every other potential victim a real favor by following through and putting this predator out of business.

If you haven't already, you =really= need to contact the BATFE. They really frown on FFL's "loosing" guns. You may only be the tip of the iceberg.
 
A little late here, but wanted to say BRAVO for following it through! I've been ripped off in the past and amazed at the complete lack of interest in our law enforcement services including Attorney General, police, and the FBI (they basically told me they were more interested in following up bigger criminals than the smaller time ones).

Oh, and if he can pick them up all day for $200, have him pick one up for you at that price as part of the settlement.

Just read the post in entirety. I love it when the bad guys feel the wrath of the good guy. It is as entertaining as TV. Of course we need "closure" too. Good luck and thanks for the posts

Wow! I cant believe it. This schlub probably figured you would blow off and not come back with any kind of retaliation. Im glad you did, and you did it the right way! CONGRATS!
