A California student has filed a federal lawsuit claiming high school officials intentionally interfered with his right to speak out on the issue of illegal immigration.

Joshua Denhalter of Jurupa Valley High School in Mira Loma, Calif., alleges he was barred from holding a counter-protest after students March 27, mostly of Mexican-American descent, illegally walked out of school in protest of legislation in the U.S. House of Representatives that would make being in the country illegally a felony.

Denhalter, represented by the public interest firm Lively, Ackerman & Cowles, says that instead of walking out and being truant, he chose to organize a legitimate and lawful counter-protest during the lunch hour March 30.


Attorney Richard Ackerman called the school's actions "one of the worst governmental censorship cases I have seen in over a decade of practice."

"It is simply unbelievable that a school district would take sides with those who promote illegal activity over a student wishing to express his protected views in a traditionally and legally acceptable manner," Ackerman said. "These officials must be severely punished for their actions."

The suit says the "peaceable assembly" was to take place across from the school on a public sidewalk, which traditionally is considered a public forum.

Denhalter claims the assembly would not have disrupted school activities because the high school has an "open lunch" period in which students are free to come and go.

Any student, therefore, could have attended the assembly during lunch without disruption or violation of truancy laws.

On the morning of March 30, Denhalter handed out fliers for the event and later was approached by school officials who told him he had to stop.

The student refused and was suspended for "handing out flyers (before school) advocating the disruption of school activities."

The suit argues, however, the school did not punish the dozens of students who walked out in violation of the law several days before.

Denhalter also points out that from March 27-30, the school allowed the radical Hispanic separatist group MEChA to sponsor an on-campus rally in opposition to the House bill.

Denhalter's request to sponsor a similar rally on campus was denied by the school board.

The suit also says that on May 25 school officials barred Denhalter from wearing a "Save Our State T-shirt.

His lawyers seek a temporary restraining order allowing him to "express himself freely as to political matters until the end of the school year," June 21.

Hmmph, imagine that: School officials blocking a legal demonstartion yet approving of an illegal action. Nope, never saw that coming...:rolleyes:

I saw this growing up, and I belive that more incidents like this will happen. I wish the kid luck, he's gonna need it living in Kali.
 
Dont you know the constitution dosen't apply within 300 feet of any school,unless your politically correct then some of it applies but the second amendment never applies.
 
here in Rhode Island, i did counter protest the illegals. What was it, May 6th they had their big rally? I was on the steps of the statehouse as soon as school got out. I think this kid and i would get along.

Another good example of why my family and I are leaving our home state (CA) for Texas. Things just keep getting crazier

The courts are on "their" side.

There is going to be serious division between militant Mexicans--not Latinos--and The Rest of Us. I don't see them winning, however, if this gets beyond the brawling-outside-the-bar stage. Stage one of the war involves ousting politicians who think illegal aliens are one of the prime constituencies.

I think that this "Latin majority" is more likely to fall on the side of traditional Conservative values than any neo-"civil rights" crowd.

Most of us (99.99999999%?) -- Latin and non-Latin -- paid little attention and went to work on those so-called "protest" dates.

The real issue -- How can we stop terrorists from using the porous Mexican border for infiltration? I have not seen anyone even discuss this major concern of mine.

Well if you want to know why the majority of these morals come from you can look simply at a few things. The majority of Hispanics are Catholic, they are hard working, and Culturally Mexico emphasizes family more than the United States. Mexican culture also places a very strong emphasis on following traditional Judeo-Christian values. The majority of these values are also the base of Conservative values. Yes there are a lot of illegals however they pale in comparison when you actually look at the number of legal immigrants from Mexico. What we need is a work pass program similar to the "Bracero Program" if we expect to turn this around.

That is my $0.02
 
The issue is whether being Roman Catholic, with larger families, and more limited work skills does not predispose them to VOTING for the Democratic Party, with its promises of family subsidies, income redistribution, and affirmative action.
 
Well Hispanics are becoming more and more Conservative as they affirm themselves as a minority group. They are moving upwards in the social ladder and they will then start to vote more and more against those democratic promises. The Irish, Italians, and other immigrants voted for those however once they were pushed out of their urban neighborhoods by the blacks once the blacks relocated to the cities they started to vote no on immigration. The majority of immigrants want them to close the doors on immigration after they get here.
 
I disagree that Latinos will innately be drawn to conservatism.

Given the communist/socialist experimentation that has taken place in central and South America and had widespread, generational support, I am not sure why you would draw that conclusion.
 
Folks who see the influx of Mexican illegal or legal immigrants as a "natural" conservative constituency are at odds with reality.

GWB was originally thought to have won 40% of the hispanic vote (later the estimate was revised downwards, sharply). This was considered unprecedented and a huge INCREASE from previous elections.

Appeals to race, Mexican chauvanism, and offers of something for nothing beat appeals to men's better angels in this constituency.

More such "victories" with hispanic voters will find the conservative cause nothing more than a footnote in later 20th century American political history.

Remember, the shorter the trip, the more baggage you can practically bring.
