Resident fatally shoots neighbor during struggle

TEMPE - A resident fatally shot a neighbor who broke into his apartment early Monday while he and his wife were sleeping, police said.

Police said 20-year-old Sivayah Edgar Tootsie beat down his neighbor's apartment door at about 3:40 a.m. at the Elliot's Crossing Apartments, 7250 S. Kyrene Road.

The two said they did not know Tootsie, who also lived in the apartment complex.

"It's extremely rare," said Tempe police Sgt. Dan Masters. "We still don't know the motive."

Masters said Jason Smith, 23, who was armed with a handgun, and his wife woke up after Tootsie began beating down the door to Smith's third-floor apartment, and the two men began to struggle.

Police said Smith then fatally shot Tootsie.

A maintenance man who lived at the apartment complex also witnessed Tootsie punch and break a 6-foot tall globe light in the complex's courtyard shortly before he broke into Smith's apartment, police said.

My oldest son lives in an appartment Tempe

One night he woke up to a noise, and saw two Mexicans burgling his apartment one was going through his closet, the second upon seeing him move jumped him. Now you need to know the boy is a part time pro wrestler, 6'8" and 400lbs a lot of it muscle. The guy on top of him was like 5'2" 135 lbs, when the BG tried to strangle him my son reached under his pillow for his knife and cut the BG's hand, getting up he then grabbed the guy and threw him across the room against the bedroom door at about the 6+ foot level, (I saw the dent) when the cops showed they arrested the still unconscious BG but the other one got away with the Rossi .22 pump I had bought him for his 18th birthday. No they never got the other guy or the gun back.:cuss:

One more thing about that same time they were having a lot of problems with drive by’s I went to open carry at least that was cool.
 
Er.. I live there! I didn't think anything of it when I came home last night but the patrol car in front of me starting speeding away from me. When I got there I saw that same car parked in our lot with two others sitting next to it. I simply assumed it was some ramdom bit of domestic violince until I saw this post. I think I should probably tell you this is a very nice part of tempe. And not your tipical slum apartments, but rather nice luxury ones.

Just goes to show you that this can happen to anyone, anywhere. Be prepaired and keep you guard up. I know I will...

You know, if I could trade all my guns to be 6'8" and be able to throw people across rooms, I think I'd do it.

Interesting, but I wonder why the other BG did not use the Rossi on your son, either I assume it was not loaded ot the sight of his friend being tossed across the room messed with his though process. And BTW, what does it matter in the telling of this story that the BG's were Mexican?

All details are important to give us a good mental picture of the event.
Maybe they were Guatamalan or from Costa Rica, but I get the picture of 2 cookie-cutter Mexicans vs. this angry behemoth. Very funny.

If you have a problem with that then maybe we need to have some kind of smiley to insert when we mention anything that might cause anyone anywhere to be bothered even slightly (BLANK forbid!)

Something like this:

Two BLANKS kicked in the door of this BLANK's house in the middle of BLANK carrying a BLANK. Thank BLANK that BLANK had a BLANK handy and BLANKED the BLANK's BLANK.

I, too, am getting a little tired of all the P.C. monitors assuming that they have a right not to be offended.

either I assume it was not loaded ot the sight of his friend being tossed across the room messed with his though process.

I'll bet more than his thought process got messed when the big guy turned his attention to the second guy.
