Resident fatally shoots neighbor during struggle

TEMPE - A resident fatally shot a neighbor who broke into his apartment early Monday while he and his wife were sleeping, police said.
Police said 20-year-old Sivayah Edgar Tootsie beat down his neighbor's apartment door at about 3:40 a.m. at the Elliot's Crossing Apartments, 7250 S. Kyrene Road.
The two said they did not know Tootsie, who also lived in the apartment complex.
"It's extremely rare," said Tempe police Sgt. Dan Masters. "We still don't know the motive."
Masters said Jason Smith, 23, who was armed with a handgun, and his wife woke up after Tootsie began beating down the door to Smith's third-floor apartment, and the two men began to struggle.
Police said Smith then fatally shot Tootsie.
A maintenance man who lived at the apartment complex also witnessed Tootsie punch and break a 6-foot tall globe light in the complex's courtyard shortly before he broke into Smith's apartment, police said.
