Transporting knives in vehicle - AZ, TX, GA

got a question from a co worker:
He needs to know the leaglity of transporting a knife in your vehicle in AZ TX and Ga.

what happened was this: His son drove out west ,
while in AZ, he purchased a knife , was told at the time of purchase that it was legal in AZ..

on the way back to Ga coming thru TX on I -20 was stopped for speeding, asked by the officer if he had anything in the car that the officer should know about, trying to be honest with the officer he produced the knife. From the way my co worker describes it, it was over six inches,

if I recall from previous discussions elsewhere, it' illegal to have a blade over 6 inches in TX, no?

Claims he going to try and prove that it is legal in AZ where it was purchased and his residetial state of Ga. He was on his way home and not bothering anybody.................

I told him I didn't think that would fly.... because just because it's legal one place doesn't matter if it's illegal wher he was stopped. I told him if he had not been speeding , he probably would have made it back ok :)
 
Don't know about knives, but firearms that are legal in one State are legal to transport through other States, firearm is legal in the State to which one is traveling. There are requirements, however, about how the firearm is to be carried.

Kid should be told to never volunteer anythng to a police officer. He was trying to do the right thng, but, in fact, the correct answer to the question should have been, "NO".

Ok, How are knives supposed to be carried in TX?

Anyone know the website for texas guvmint? or TX AG?



They have alllready spoken with AZ AG and he too confirmed it was legal in AZ.....
 
I'm sorry, but I don't have any idea how the state of Texas wants knives to be handled during transit.

My personal opinion is: it isn't any government's business what I have in my pocket or on my floorboards unless I hurt somebody with it, but then that's my particular obsession, I guess.

I'm always sorry when I hear about something like this. There are too many laws. It makes it too easy to run afoul of one of them, with nasty, long-term consequences that aren't deserved.

With all due respect to members of the bar on this forum: there's too many attorneys these days. The duel was a fine way of settling immediate interpersonal problems, often permanently.
 
What type of knife was your son carrying in the car?

What part of the car was he carrying it in?

Was it in a package (I know that's a stupid question, but I gotta ask:rolleyes: ) that was closed, like a box? Got a receipt from the store? From the TX LEO?

TX Code says:


Texas - Health, Safety & Morals - 46.02. Unlawful carrying
weapons. (a) A person commits an offense if intentionally,
knowingly , or recklessly carries on or about his person a
handgun, illegal knife, or club. [Exceptions: official;
actor was own premises; was traveling; engaged in lawful
hunting, fishing, or other sporting activity; security
guard].
- 46.01. Definitions. (1) "Club"... includes... (D)

(6) "Illegal knife" means a:
(A) knife with a blade over five and one-half inches;
(B) hand instrument designed to cut or stab another by
being thrown;
(C) dagger, including but not limited to a dirk, stiletto,
and poniard;

(7) "Knife" means any bladed hand instrument that is capable
of inflicting serious bodily injury or death by cutting or
stabbing a person with the instrument.

- 46.05. Prohibited Weapons. (a) A person commits and offense
if he intentionally or knowingly possesses, manufactures,
transports, repairs, or sells... (5) a switchblade
knife... (d) It is an affirmative defense to prosecution
under this section that the actor's conduct: (1) was
incidental to dealing with a switchblade knife,
springblade knife, or short-barrel firearm solely as an
antique or curio...

If he was carrying a switchblade that he legally picked up in AZ (you can do that in AZ) and he got stopped in TX then he was in violation of TX law just having it at all (if he wasn't bringing it home to dad as a present for his "curio" collection). If he wasn't carrying it on his person and he was stopped "traveling" this section is relevant - "carries on or about his person a handgun, illegal knife, or club. [Exceptions: official; actor; was own premises; was traveling;
 
it wasn't MY son, it was a coworkers son...
it was a butterfly knife which is legal in AZ according to the store wheere he bought it and the AZ AG..

where it was in the car and whether it was wrapped or not I don't know..., but I can find out..

on another list I was told that there IS an exemption for travelors,

Butterfly knife in the car of someone traveling from AZ to GA through TX? Unless the LEO was a local instead of state officer and there was a local law on the books that prohibited butterfly knives I'd say it's time for your coworker to hire a lawyer.
 
As far as transporting knives in vehicles...I've never had a problem.

I've been stopped with about twenty bayonets in plain view on the passenger seat, a katana, machete etc. I believe all the laws in Georgia are geared toward the concealed carry of knives.
 
the kid got fine plus court cost $519.00, plus year probation, if he "behaves in , at the end of the year , he can request that his record be cleared..... I thot he shoulda got travel exemtion but...................
