Just standing there. No doubt out for a bit of fresh city air on a street corner, at 2:35 in the AM. I'm sure he didn't have any ties to other statute-prohibited activity.
I'll bet a lot of people were "just standing" behind booze-laden Model A trucks in 1920's Chicago when they were suddenly mowed down in an entirely random act of violence.
