Legislative Update from Olympia 1 February 2008

At the suggestion of a few subscribers, I have merged the “Bill Status”
and “GOAL Position” sections to provide a faster connection between
bills and GOAL’s position on them. It should make for an easier read of
the GOAL Post.

A handful of new bills were introduced this week, all in the Senate.
They include SB 6841 (Murray, D-43) that would add a section to RCW 9.41
prohibiting firearms and other weapons on all college campuses; SB 6859
(Morton, R-7), a counterpart of HB 3225 that limits the Dept of Fish &
Wildlife’s ability to regulate firearms on DFW-managed land; SB 6860
(Roach, R-31) which clearly extends state preemption of firearm
regulation to college campuses, SB 6861 (Roach, R-31) expands the
opportunities for reciprocity of CPLs with additional states; and SB
6864 (Roach, R-31) which recognizes CPLs issued to any active duty
military member serving in Washington.

Friday, 8 February is the policy committee cut-off in the original
chamber. This means that bills must pass out of their original policy
committee (e.g. House Judiciary, Senate Judiciary, etc) or they are
considered dead for the remainder of the session. Of more than 30 gun
bills filed in 2007 and 2008, only a few will be considered “in play”
after next Friday. Note that next week’s schedule is already out, and
most of the pro-gun bills are NOT scheduled for a public hearing. That
means in all likelihood they will die next Friday evening.

(Reminder: The session calendar is a creation of the legislature, not a
constitutional requirement. The legislature can choose to ignore the
adopted dates and move bills previously considered to be “dead” under
the calendar. As the saying goes, “It ain’t over ‘til the fat lady
sings,” and she doesn’t sing until the session actually comes to a close
at midnight on March 13^th . )

Public hearings are scheduled for at least three bills this week, one in
Senate Judiciary (SB 6763) and two in Senate Higher Ed (SBs 6841 and
6860). The Senate Higher Ed hearing appears to be this year’s “face-off”
between pro- and anti-gun bills, this time addressing firearms on
college campuses. A separate GOAL Alert has been published calling for
attendance at the Thursday morning hearing. In addition, a few bills are
scheduled for “Executive Session” meaning a vote will be taken to pass
them out of committee. The schedule has been changed several times, and
is subject to change on an almost daily basis (despite the nominal
five-days notice required). Details on the public hearings are listed
below. THE HEARING TAKES PLACE IN SENATE HEARING ROOM 3 IN THE JOHN A.
CERBERG SENATE OFFICE BUILDING.

If you are able to attend the Senate Higher Education public hearing, a
little something to keep in mind: both Republicans on the committee have
solid pro-gun credentials. Democrat Senator Tim Sheldon is solidly with
us; Democrats Derek Kilmer and Jean Berkey have voted pro-gun.

If you could just keep Senator Ginny Burdick down in your state...she came up here pushing legislation to close the so-called "Gunshow Loophole". At least we thwarted the anti's attempts - Oregon was not so lucky.

THANKS TO HEARING ATTENDEES

Friday evening was policy committee cut-off. At least theoretically,
bills that had not passed out of their original policy committee are
considered dead for the remainder of the session (subject to a majority
“pull” to the chamber floor).

It appears at this time that only five gun-related bills have survived
the cut-off: HBs 3029, 3131 and 3148 and SB 6322 and 6763.

An amended version of HB 3029, SHB 3029, passed out of House Judiciary
to House Appropriations, where they must approve expenditures caused by
the bill. HBs 3131 and 3148 passed from Judiciary to House Rules in
substitute (amended) form as SHBs 3131 and 3148. SB 6322 has been
sitting in Senate Rules for more than a week. SB 6763 was sent to Senate
Rules this week.

Two additional Senate Bills, SBs 5456 and 5465 are technically still
alive in Senate Rules. It’s unlikely you’ll see any action on either
bill, although the language in SB 5456 could be used as a striking
amendment for HB 3148 if it goes over to the Senate.

The next major cut-off date is Tuesday, February 19^th , when all bills
must pass their chamber of origin (House bills out of the House; Senate
bills out of the Senate. Most of next week’s schedule is devoted to
House and Senate floor sessions (which are usually televised live on TV
Washington and may be carried by your local cable television outlet).

NEW BILLS

Only one new gun bill was introduced this week, HB 3359, by Rep Al
O’Brien (D-1). HB 3329 requires encoding – serial numbering – all
handgun ammunition sold in the state of Washington. This idea has been
kicking around for several years, and up until now we have been able to
keep it out of the legislature.

HB 3359 requires all ammunition primarily intended to be fired in
handguns – this could include .22 rimfire (it clearly includes .22
rimfire pistol match ammo) – to have BOTH the projectile (bullet) AND
cartridge case marked with an identifiable serial number. It also
includes pistol bullets for reloading. Retailers are required to report
the sale of ammunition with the serial numbers involved and the
identifying information taken from government-issued ID, to the state
Department of Licensing. The requirement takes effect January 1, 2010.

HB 3359 was assigned to House Judiciary for action. It was introduced
just after the policy committee cut-off (Judiciary’s last hearing before
cut-off was held on 5 February), so theoretically the bill will not be
acted on. As noted above, cut-off dates are set by the legislature, and
bills can be pulled from committee directly to the chamber floor.

There isn’t enough room in the GOAL Post to cover all the flaws in HB
3359! The bottom line is, as written, the bill would have a major impact
on consumer ammunition costs AND on state bureaucracy, requiring
significant staff expansion to meet record-keeping requirements.

(The anti-self defense lobby – the gun control lobby – is promoting
so-called “microstamping” bills in eight states this year (most in the
Northeast) and versions have been filed in Congress. While HB 3359 is
unlikely to go anywhere this year, don’t expect it to just fade away.
California passed – and Schwarzneggar signed – a bullet encoding bill
last year.)

PUBLIC HEARINGS HELD, SCHEDULED

There are no public hearings scheduled to be held on gun-related bills
next week.

A lively public hearing was conducted in Senate Higher Education last
Thursday on SBs 6841 (college campus gun ban) and 6860 (allows carry on
college campuses with CPL). More than 50 citizens in attendance
supported SB 6860 and opposed SB 6841, of whom more than a dozen
testified. In favor of banning guns on campus were only four individuals
by one count. Only three testified in support of the ban.

Unfortunately Higher Ed committee chair Senator Paull Shin (D-21)
supports gun bans. He has refused to bring either bill up for a vote in
the committee, where all Republicans and other Democrats support the
right of citizens to armed self defense. Unless sufficient pressure is
brought to bear on Senate leadership, SB 6860 will die.

Every gun owner, every citizen who believes in the constitutional and
natural right to self defense, owes a big THANK YOU to those individuals
who were able to make the trek to Olympia for the hearing. It is events
like this that demonstrate the true feelings of Washington’s citizens on
this critical issue AND the lack of support for gun control. One would
have thought that lesson would have been learned with 1997’s Initiative
676, the handgun owner licensing initiative, which went down to a
stinging – and stunning – 71-29% defeat. Or last year, when more than
300 gun rights advocates filled three rooms during the hearing on SB
5197, the so-called gun show loophole bill. It’s sad how arrogant many
of our elected officials are, to ignore the will of the majority of the
people in favor of a very small but politically-correct minority.
