WA state Buying a firearm for 1st time, but..

1st of all, hi everybody. i just joined this site.

my English is not so great. so please understand.

anyhow, here is my story.

Right now i am a permanent resident and live in WA state.

couple months ago, my friend and i went to shoot clays. it was my 1st time shooting a gun (shotgun). i was hooked. and i wanted my own gun (shotgun) to play.

But, i did some stupid thing that i regret when i was under-age. because of that, i have juvenile record. However, my juvenile record has been sealed and expunged.

Now, i am 24 with no record. (also court told me i don't have to check "yes" where if i had any criminals on applications)

so, last week i went to BI-MART to buy a shotgun. when i was filling paper work. i had to think if i should check "yes" or "no" part where i had any criminal records. Lady at the desk asked me again. i said "yes" and told her about my juvenile record that is sealed and expunged. she asked me again, just yes or no part, didnt say anything about my record. Also reason i said yes is, she told me if i lie this will be another criminal convict and i really don't want that. (i check "no" on many JOB applications and never had a problem) after i checked "yes" she said, i cant process this paper work. and i walked out.

i am planing to stop by at local sheriff office and ask them to check my background(see if my juvenile record is gone and clean) i tried to call them but only machine picks up.(because of job, don't have time)

so main point is, if record(background-check) come out clean at sheriff office,its clean-clean? should i worry about NICS check? might show up on there? or they use same system? And clean means i can mark "NO" on if i have any criminal records? even i had that juvenile record sealed and expunged? sorry for asking same thing over and over. i just want make sure everything go smooths.

If your childhood criminal offense is off your record, it means its gone so don't write yes, write no. They only can check based on what is actually on your record. If you can be more specific about your offense and how long go it happen it can help people a bit with the answer. For example, I know of people who got busted shoplifting or drunk in public at 12 and they knock those type of things off your record. You can perform a background check on yourself to see if you can are eligble to buy a gun. I think the main problem is felonies and domestic abuse related misdemeanors. If you're a felon I think you will know it in many ways more than just buying guns. I know others in this situation.
 
To own a firearm, you need to get an AFL first in WA.
Without one you could get arrested for class C felony.

Okay, i read threads about AFL.

wow, i didn't know how hard to own a firearm. lol

only thing iam worried about is that like i said, my background check. if it checked out okay, at sheriff no problem?? however it could show up on upper data base??

like it showed nothing at sheriff's office. so checked "NO" on "Have you ever been convicted in adult court or adjudicated in a juvenile court, in this state or elsewhere?"
then, it shows up on other high data base and screw me over.:eek::eek:

maybe i will wait 4-5 years to be a citizen. lol
 
I'm not sure how the juvenile records work...

You do need to get the AFL first.

The process of getting the AFL will determine if you can own a firearm, as the background checks for the AFL will decide if you can possess or not.
 
As the others have said, mark no on the 4473 and don't worry about it. BUT, in Washington State, you MUST get the AFL FIRST! I am not sure if they are actually issuing the AFL's again or not.
 
I went ahead and got my AFL... but the .GOV.WA is really hoping to get HB1052 passed...

They are trying to get it passed so that foreigners can get a license to train for the Winter Olympics and so that people can hunt in WA state...

But the silver lining... Legal Permanent Residents from anywhere in the USA would no longer need the AFL...
 
What the heck is an AFL?

I recently moved to WA from OR, so I am not 100% familar with the rules here yet. Is this something I need to worry about?
 
If you are a US citizen, no, you don't have to worry about it. It is Alien Firearms License for non-us citizens in WA state. A non-us citizen has to have one to possess a firearm in Washington.
 
So, on 4473 part "C" i can check no?? http://www.atf.gov/forms/4473/

also what about on AFL form?
1. Have you ever been convicted in adult court or adjudicated in a juvenile court, in this state or elsewhere,
of one of the prohibitive crimes described on page 4 of this form?

check "NO" on this too?? iam worried. lol

And do i really need background check form from my own country??
 
Just check no and be done with it. The signatures on the forms all have "to the best of my knowledge" truth verifications associated with them. To the best of your knowledge, you were instructed by the courts that you had no criminal record, and that you could check no to those questions. It's no big deal even if you do get denied, a lawyer could work out the denial for you and get it turned into an approval, if your record was actually expunged.

They are not going to come after you to arrest you if all that is there is a juvie court conviction that was sealed and expunged.
 
I don't know if anyone has recommended this or not, but there are in fact a few web-services where you can do a free background check on yourself (or anyone). You should try that out. If you Google 'free background check', you'll get a lot of results. Make sure that you're finding one that will do at least the first check for free.

Also, just check 'NO' because that is the accurate answer that truly applies to you.
 
Were you born in another country? Just asking since you said your English is not so great.

In some states foreign born US citizens must bring their passport and naturalization papers to buy a gun, so you might want to bring those just in case it is the same in WA.

WA DOL will not take 3rd party background check, otherwise they would have had a copy of my CPL check...

Funny thing about an LPR, we are considered a US citizen... under the 14th amendment since we're under the jurisdiction thereof the United States.... actually the INS etc...

FACT: on AFL. i dont need background check form from my own country, if i can prove i lived here longer than 2 years.

I really don't have extra money to pay a lawyer. I mean I am really careful person. even i made stupid mistake that i regret every time i think about it.

On the AFL form, they ask for I-94 number. when i looked my I-94, there is no number that start with #A. (little paper with a departure/arrival number on that goes with my passport). However, when i looked my Green card, there is number start with #A. am i missing something here?
 
Anyone can verify this? i want to turn in paper work soon as possible. before law changes.
 
Use your alien number on your PR card. That is your alien registration number, your I-94 is your entry if you are a non-immigrant. Your alien registration number, or A# is the relevant one. Good luck. The bill passed today, so if you wanted to wait a few months you'd be right. All the best.
