Walmart gun sale rule.

A friend of mine went to buy a shotgun at Walmart yesterday and at the final part of the sale ,he was told there was a 3 day wait until he could pick up the shotgun. He has a FL drivers license and a FL CCW.
On questioning the sales person ,he was told this is a new Walmart rule.
He declined the sale.

Anyone else run into this?
 
They cannot over ride state law, he doesn't need the CCW for a long gun to avoid waiting periods. That is only for handguns and only for those without a valid CCW

They can't -violate- state law, but there is for sure nothing that says they can't be more restrictive than state law. If "company policy" is a 3 day waiting period, then so be it. Your choice is to go elsewhere.

That said, I think it's likely that the Walmart clerk (who was an expert on ladies shoes last week) simply doesn't understand the Fla waiting period and applied it to all guns, rather than just handguns.
 
Agree with mgkdrgn. LGS I worked at wouldn't release a firearm unless 10 business days passed with out a call from NICS.

It's probably an ignorant sales person. Though the county does make a huge difference. I think Broward, Dade and maybe Palm Beach are a 5 or 7 day wait without the permit for ANY gun. In FL the CCW permit exempts you though from a wait, but not the FDLE check. I'm in school up state but refused to purchase in Broward, my home, because of their asinine extra wait period (even with my CCW exemption).

Broward's ordnance does not (actually none of the county ordinances) apply to CWFL holders:

Sec. 18-98. - Non-applicability to holders of Florida concealed weapon permits.

Pursuant to the Florida Constitution, when purchasing a firearm, holders of a Florida concealed weapon permit or license, as prescribed by general law, shall not be subject to the prohibitions and penalties of this article.
 
I am pretty sure the 3 day wait is a state law for Florida. At least, that's how it was when I lived there.
 
Not if you have a carry license, I have purchased dozens of guns here in Fl over the past 20 years, and never waited for one. If you have a ccw you pay and go. That is the law
 
Never expect a legal scholar in gun law behind a Walmart counter. At my local one, the girl from the hardware department often covers sporting goods also, and knows nothing about this stuff.

This is probably true at most any big box store that sells firearms, and actually for many Gun Stores as well. WalMart is far from being alone in this regard.
 
They had an AR at the walmart I visited today... just about found out what the waiting period was. Too bad the county is still holding up my CCW renewal, or I would have considered buying it (already at 90 days...)
 
Sorry,,,it was Lee county Ft Myers. The young lady was very firearms savvy and stated it was a new Walmart rule.
It didn't matter that my friend had a CCW,it's a store rule and they have the option to enforce it.
After talking to a few people (not too sure how accurate this info is),I'm told this is something Walmart is doing to appease the political machine who had asked Walmart to stop selling guns and ammo alltogether.......
 
I've actually had some issues like this at Wal-Mart also. Some of their policies are incredibly dumb. I actually was at wal-mart one day and was buying non-alchoholic margarita mix with a friend, and they ID'd both me and him. Another instance was where he was purchasing 9mm ammo, and they wouldn't sell to him because he didn't have a CCW at the time. As far as policies like this go, it really doesn't suprise me one bit given how (insert unhighroad language here) their cashiers are.

Should have asked to speak to a manager.
 
Why in the World is anyone buying a firearm from Wal-Mart in the first place?
We should all be supporting our LGS's.
 
Escambia county Fl you can buy any long gun from WM and walk out the store with it.They do not sell handguns.
 
Call the store manager in, Also report them to the ATF, and Dept of Agriculture, "that's wh handles business licenses in FL" www.fl.gov, It's not legal to withold a paid for weapon from a licensed carry holder. You actually may call a local deputy, "let themtry and explain stae law to them", it's not optional, anyone who has a valid license walks with whatever they purchased, it's not optional.
If they violate the law they can be shut down.

It takes up to THREE MONTHS to get your Florida permit, so please be patient after you apply.

In Florida, the license issued by the state is a "Concealed Weapon or Firearm License" (CWL). As such, it is valid not only for firearms but also for other categories of concealed weapons, such as knives, saps, chemical sprays, etc.

"Open Carry" is (almost) never allowed, whether for licensees or non-licensees! (See exception in "Carry without permit" below)

Reciprocal privileges are granted to resident licensee/permitee of states as indicated below. The Attorney General has authority to enter into agreements with other states.

(b) There shall be a mandatory period of three days, excluding weekends and legal holidays, between the purchase and delivery at retail of any handgun. For the purposes of this section, "purchase" means the transfer of money or other valuable consideration to the retailer, and "handgun" means a firearm capable of being carried and used by one hand, such as a pistol or revolver. Holders of a concealed weapon permit as prescribed in Florida law shall not be subject to the provisions of this paragraph.

(c) The legislature shall enact legislation implementing subsection (b) of this section, effective no later than December 31, 1991, which shall provide that anyone violating the provisions of subsection (b) shall be guilty of a felony.

(d) This restriction shall not apply to a trade in of another handgun.

The right of the people to keep and bear arms in defense of themselves and of the lawful authority of the state shall not be infringed, except that the manner of bearing arms may be regulated by law.

he was going to buy a Mossbert 930 personal defense shotgun and no one has them except Walmart every so often.

the 3 day rule is a WM policy at least for that store.....
