New York: Albany County Taking Aim at Ammunition Sales Tonight!

Monday, March 09, 2009

Please Stand-Up and Make Your Voice Heard!

At tonight’s meeting of the Albany County Legislature, Legislators Phillip Steck (D), Douglas Bullock (D) and Wanda Willingham (D) will introduce Local Law “A”, a proposal that would regulate the purchase of ammunition in the county of Albany.

Local Law “A” would require that a valid firearms license be shown when purchasing ammunition. The law would also mandate that retailers keep a record of ammunition sales, including the type, caliber, and quantity of the ammunition, the caliber, make, model and serial number of the firearm it is for, as well as the purchaser’s name and address.

Please attend tonight’s meeting at 6:30 P.M. in the Legislative Chambers of the Albany County Court House (on the second floor) on Eagle Street in Albany to voice your opposition to this proposed ordinance. If you are unable to attend, please contact the County Legislators and voice your opposition to Local Law “A.” County Legislators can be reached by phone at (518) 447-7168 or fax (518) 447-5695. For more contact information, please visit http://www.albanycounty.com/departments/legislature/legislator.asp?id=165.

Isn't that illegal per the Firearm Owner's Protection Act of 1986?

Hadn't exactly this sort of foolishness been tried in federal law years ago, and been found completely useless? That's the case, as memory serves. Of course, some NEVER learn.

Excuse my ignorance, but why is it an issue? Living in Ontario Canada that's how its done. Takes a little longer to get through the cashier but other than that its never been a problem.

How does this take away from your freedom?

Dont get me wrong im not for it, its as useless as gun registration IMO but it doesnt really hinder me purchasing firearms or ammo.

^---- Because Big Brother has no need to know if I bought a case of 9mm tonight or last week. This is supposed to be a free market, in a free country. Right now I don't see either. If you wish to live in Canada, that's fine, but I don't and I don't argee wih the governement having any record of my purchases. What's wrong with having personal liberty and freedom from govermental scrutiny?

And I sincerely hope that this issue fails miserably, and that these idiot office holders are taken from their positions.

1) It is against the law according to the 1968 gun law

2)The ammo list NEVER solved a crime

3)However It may have caused a crime. Think of this as a shopping list for bad guys

4) Truthfully, I don't care how it's done in Canada, this is the USA & I am sorry that you guys up North have such Draconian Firearm laws.

No argument there, the government already has its nose into to much of people personal affairs as it is. That I understand. There's actually talk of getting rid of the whole gun registration thing here. They just keep pushing the deadline back every year. I wouldnt argue with that idea at all.

quantity of the ammunition, the caliber, make, model and serial number of the firearm it is for

I've seen some of the pictures posted by members of this forum: "These are my 27 favorite S&W model 10s. I'll post pics of the rest later" lol

How do you decide which round in a box of 50 will be used in which gun? And what if you say they were for your 10-5, but you decided to shoot them in your 19-3 instead, what then?

my parents moved me down from Canada to the US when I was 12 so i went to High School here and I serve in Iraq with the U.S. Army after being here for 14 years now I love this government more, despite them wanting to take more and more of our personal freedoms and be just like Canada. I can see it now instead of adding more stars to the U.S. flag when American and Canada becomes one, we just turn the stars into maple leafs!

The nice thing about living in the states is you know if the government goes to far that there are plenty of armed citizens to stop them.

sbarkowski,

There are several things wrong with it.

1. Shouldn't have to have a "firearms license" in the first place.

2. Caliber, Make, Model and Serial number of the firearm it is for... 9mm is a good example. I have 6 9mm guns. Which would I list? Would I list them all? I've gone to the store and picked up ammo for 9mm, .45ACP, .38 Special, .44 Special, .223, 7.62X39 and .22LR in one trip. I have 6, 3, 5, 3, 9, 3, 4 guns in these calibers respectively. For this purchase alone I'd have to put down 33 sets of information. This could be a very time consuming activity, all for a trip to the range. Just in case I happen to decide to pick up some ammo I'd have to keep a much larger number of serial numbers etc with me at all times. Not an issue? I think it would be.

3. What societal benefit could this possibly provide? This is obviously a law intended to obstruct a normal activity of a citizen, there is no benefit and should therefore be no law.

4. It restricts my freedom to be a private citizen.

I was born in that county and this is so stupid I cannot believe it. In Nevada I rarely feel threatened, but walk through Washington Park at night I don't think so. I mean you could walk to another county and buy ammo so *** do they thing such a law will do besides drive business out of the county. The cops in the city of Albany have proved themselves to be some of the worst around and I would not rely on them for protection. The David Scaringe incident hits the closest to home for me with him being the only person I knew personally being killed by a gun on American soil and by a cop no less. Albany county is not very good at issuing pistol permits so the police are relied upon even more. I am filled with bile and anger right now and wish I could go to that meeting to laugh at the idiots. Who in their right mind would think that such a law would do anything positive? I find it hard to believe that the people I grew up around can have their heads so far up their. . .I am officially angry.

As far as I know there is no licensing of long guns in NY so I am wondering if this is caliber specific to "handgun" ammo. How can you show a license if one doesn't exist?

Correct a PAL is required to purchase long guns and ammo, you need a restricted licence to purchase a pistol or anything on an AR type platform, and a prohibited/collectors licence to own anything full auto. They do NOT require your firearm's serial number when purchasing ammo here. Im not saying i agree with it because i dont. Its a big money grab. It cost me $275 to take my firearms/hunting course and get my licence plus they do a criminal background check after you take your course, so if you have a record you've paid that money for nothing because you wont get a licence. It's crap and I dont agree, but thats how it is for us. I wanted to own firearms bad enough to battle my way through all the red tape as have many others. If we had the kind of freedom that those of you have in the USA your damn right we would fight to keep it too. As it is now we're fighting to keep what little we have. Here we have the O.F.A.H. (Ontario federation of anglers and hunters) its a strong well funded organization that helps keep what rights we have. Plus being a member gives you 3 million liablilty coverage for anything shooting, hunting etc. related should you ever have an accident or require legal help. Who knows how far they'll try to take it. So in a way I can see where your all comming from and I hope for the US citizen's sake you dont end up with the same laws we have here.

Albany County is one of the most restrictive in the state, so it doesn't surprise me that they're introducing this here. What does surprise me is this:

Local Law “A” would require that a valid firearms license be shown when purchasing ammunition. The law would also mandate that retailers keep a record of ammunition sales, including the type, caliber, and quantity of the ammunition, the caliber, make, model and serial number of the firearm it is for, as well as the purchaser’s name and address

There is no record of long gun serial numbers the way there is with handguns. What's to stop someone from walking in to a store and saying, "This ammunition is for my AK-47, serial number 123456789"? Unless this law includes the ability for LEOs to come to your house and inspect your firearms to ensure that you're telling the truth about which guns you're buying them for, how are they going to enforce this?

On a related note, if what they're concerned about is people buying handgun ammunition for illegal handguns, what is going to keep someone from saying, "I'm buying this .45 caliber ammunition for my Beretta Storm pistol-caliber carbine," giving a fake serial number, and just taking the ammunition and loading it into their illegally-owned .45 caliber pistol?

And, in the legal realm, what if you're buying the ammunition for a gun which is not your own (say, a friend's gun), and you don't know the serial number?

Or what if you're buying it in anticipation of a purchase later in the month, and you don't yet know the serial number of the weapon you plan to purchase?

And - as others have asked - does this mean I can't order ammunition over the Internet from out of state? Am I allowed to purchase ammunition in out-of-state stores and bring it back to NY?

There are a range of scenarios that lawmakers clearly haven't considered when crafting this legislation.

Firearms license? We don't need no stinking firearms license.

What the H is a firearms license anyway? I suppose all hunters will need to get one huh?

Can a police officer come in and purchase ammo without it?
