Hutch man arrested after accidentally shooting son in leg

Reno County Sheriffís deputies seized 39 guns and arrested a rural Hutchinson man Saturday evening after they responded to an accidental shooting.

Robert Smith, 51, of 14608 Mayfield, was taken to the Reno County Jail on suspicion of possession of marijuana and possession of drug paraphernalia shortly before 7 p.m. Saturday.

According to police reports, Smith told police he accidentally shot his son in the leg. Police asked to see the gun used in the shooting, and Smith said it was next to his son.

When officers couldnít find the weapon, Smith asked his wife to retrieve it inside the home. The woman produced two handguns, neither of which was the weapon used in the shooting.

Police followed Smith into the house, and he produced the gun, a .357 Ruger. While in the home, officers allegedly detected the smell of burnt marijuana and told Smith they needed to collect all his weapons until they completed an investigation.

During a search of the home, police allegedly found a bong suspected of being used to smoke marijuana, an ashtray with residue and the 39 guns.

Smith is free on $1,000 bond.
 
Took all his guns because of an accident? Can they do that?
I wonder if they took all Cheney's guns away...

I guess maybe the weed had something to do with it..?

you can accidentaly shoot your gun but you better not have a single roach in your car.

That is one lucky kid.

He could be dead. There is a friend of mine who lives in another state who has been smoking pot since he was 15. (Now also 51.) He swears it doesn’t harm anything, but I’ve seen him search for his car keys for half an hour when they are in his pocket. He has a hard time remembering the events of the past day, and trying to have an actual conversation with him when he is stoned is a joke. The sad thing is he actually believes smoking pot helps him think and act better then when he is straight (Although at this point he is right.). He recently inherited his Dad’s Marlin lever rifle and I think it’s just a matter of time before he shoots himself, his wife or daughter with it.

I guess it's just another example of Darwinsm in action. :(
 
Crazed_ss, they took his guns temporarily I assume. Officers can confiscate your weapons while they are in the home as a safety matter. I do not think they took them with them when they arrested him. As for owning that many guns, I see no problem with it. I can easily see myself there someday. I doubt it was accidental though since most of these situations turn out to be cover ups of why one famiy member actually tried to hoot another one. As for drugs and guns...THEY DO NOT MIX...especially if that drug is alcohol. I do not drink or use drugs but I think it is silly that we place such a taboo on marijuana that we arrest people for it, crowd prisons, and have to release violent offenders because of it.
 
sounds like he may have gotten off lucky because he already smoked all the weed. At most it sounds like they can charge him with the accidental discharge and possession of drug contraband (the bong).
