Gun standoff at Table Rock ends in Boise man's arrest
Man is charged with DUI and resisting arrest after he pulled a pellet gun on three men.

A 37-year-old Boise man was arrested and charged with felony aggravated assault after he drew a pellet gun on a man who happened to be legally concealing a real pistol.

Damon Glenn Smith was also charged with felony DUI and misdemeanor resisting arrest after the incident at 11:48 p.m. Wednesday at Table Rock, a popular sightseeing spot overlooking Boise.

Matthew Pond, 19, said that as he and two of his friends drove up to the mesa for the view, they passed a truck that was trying to go off-road. When they reached the top, the truck pulled up behind them and the driver - later identified as Smith - started yelling at Pond.

"I could tell (Smith) was extremely intoxicated so I just tried to talk, to tell him there was no problem," Pond said. "That was when he said 'Do you want a problem?' and pulled out the gun."

But Pond had a weapon, too - and a valid concealed weapons permit, police say. Pond said he got out of his car and backed away slowly as Smith got out of the truck. Pond said he did not pull out his own pistol as he tried to defuse the situation.

Smith repeatedly pointed the gun at Pond and his two friends before he finally put the pistol in the back of his pants and started yelling at one of Pond's friends, Pond said. Pond then approached Smith and put his hand on Smith's gun while pulling his own at the same time.

"I said, 'I don't want to hurt you. I want us all to walk away from here. But if I need to, I will (shoot) you,'" Pond said.

Pond said Smith resisted for a second but then gave up the handgun, which turned out to be a pellet gun.

Smith got into his truck and drove away, and Pond called 911. But Smith came back and began arguing again and asking for his gun back. He tried to leave again as the police showed up.

Pond, who said Thursday he has legally carried a gun since he was 18, was just relieved the situation was resolved without anyone getting hurt.

"I am amazingly glad I had the means and training to handle a situation like that and everyone was able to walk away," Pond said.

Boise police spokesman Charles McClure said Pond displayed his handgun legally and was fully within his rights to defend himself.

I'll admit, I didn't know one could legally CCW at 18 in Idaho.

Let hear it for a fellow Idahoan. He handled himself very well. And let this be a lesson to everyone. Don't bring a pellet gun to gunfight.
 
Technicaly, if the intoxicated guy already had his "gun" out, Mr. Pond was behind the curve and likely would have been hit in any ensuing gunfight. The fact he was able to talk the situation to a close shows a cool head in action and I won't think less of that. Hopefully the drunk learns his lesson.
 
Don't read a whole lot of stories like that. I wonder where Pond received the training he refers to.
 
Pond seemed cool as ice to me.
Smith is lucky he is still breathing.
Pulling a pellet gun on someone is just stupid.
Someone a little less cool would have drawn and shot Smith.

I will be the first to say that If I was carrying and someone pulled a gun out, I would be taking my gun out too. This guy did better then I would ever do.

Thank GOD most criminals are also idiots.
 
And to the question above....in Idaho CCW only applies inside city limits. Outside city limits you don't need to have a permit. No sure how he got a permit for inside city limits at 19 though as pretty sure it's 21 with no caveats for 18+
 
Jeez, in Chicago & NYC the pOlice will put 26 holes in you just for holding a cell phone. Of course Police ARE better trained then your average CHL. Only the police should have guns. :D
 
Not terribly high road.

Actually, it seems extremely High Road to me. A number of members here have informed us that, as a fellow sheepdog, Mr. Pond had an obligation to respond to the wolf with overwhelming force. Preferably in the form of handcuffing the pellet gunner, driving to the CCW holder's home, locking him into the living room, and then shooting him repeatedly, preferably with something cool like a GLOCK .40 or a heavily modified AK-47.

I, for one, feel a little let down.
 
Once again, a man like Mr. Pound shows the anti gun liberals that we (CCW holders)are not Wyatt Earp shootem-up cowboys.

Cities like D.C. and Chicago need to think about the guns in the hands of responsible citizens and not the thugs.:cool:
