What ever happened with the nassau county NY assault weapon bust?

around 9 months ago kathleen rice executed 9 arrests in 4 nassau county gunshops as the result of an undercover investigation into illegal assault rifle sales. She claimed that guns that where sold to undercover officers could be readily converted to auto killing assault style simply by unpinning the stock, this made them specificly for assaulting and not hunting.

the quirk for those not familiar with the particulars of NYS AWB is that law enforcement and peace officers are allowed to have "the evil rifles". Now keep in mind LE were the ones who purchased BAN COMPLIANT rifles as part of this sting. Even if the officers then converted to a collapsible stock (which they were not sold as, infact one gun store owner warned them that if the pin was removed it would result in big trouble) would still be legal after the conversion (remember its LE officers who now own these rifles).

these arrests seem like the perfect oppertunity to get the NYS AWB repealed. if a lawyer layed out three 3 AR15s on a table, 1 with a pinned closed stock, 1 with a pinned opened stock, and one with a real collapsible stock... we would then plainly in easy terms explain how rediculous this law is

with a lot more searching i found that the felony charges were filed 8 months ago however nobody has been indicted. i was under the impression that the da was under an obligation to bring an indictment within a certain time after arrest, is that true?

i also found that there is a legal fund developed for the defendants of shouth shore sportsman, in massapequa. i would be willing to donate heavily if its to fight the injustice of the case, but not if a plea deal would be taken (which would set HORRIBLE precedence in NY)

Does anyone have any word at all on this case?
Is the lack of information available because nobody has been indicted?
 
i dont have any info but all i can say is thank God that Kathleen Rice lost the NYS Attorney General race.
 
I don't know anything about the NY situtation, but it smells a lot like when bloombergs storm troopers showed up at Arizona gun shows.
 
Oh my goodness, anywhere else and the ambulance chasers would be popping out of the woodwork to represent these guys to get their 30%.
 
I'm still having trouble figuring out why this is such a quiet issue, especially with someone elses thread re: the NYS AWB?

this whole situation reaks and nobody has a clue about it, nobodys stepping up to defend these innocent people, barely anyone even knows about this egregious abuse of power by the NPD and NYS.

remember, these people didnt even sell rifles with shoulder things that went up, they simply sold postban, stock pinned, bayo lug removed rifles
 
You have to realize that thousands of people are arrested every year by law enforcement and never end up going to trial and the charges are dropped or they hope the defendant pleads to a lesser charge because of the burden of paying for a defense attorney all the while the charges are bogus.

All of the US went thru the ridiculous AWB with bayonet lugs, collapsible stocks and high cap magazines for much of the 90's. It had zero effect on crime as evident by the DOJ's own crime stats.

Apparently your former AG had a thing for AWs and used her position to make undercover buys hoping to catch an illegal sale. Now that she is gone the case may not be pursued or they are doing further testing to see if the AW's are indeed legal or they can be modified and made illegal with little effort.

Everyone is due a speedy trial. If I was a defendant and had been charged and knew I was innocent I would insist on a speedy trial to force their hand.

They could drag this out for a long time and it end up just fading away with any possible charges dropped. This is where a good attorney comes into play.

Unless they were clearly illegal arms sales, my best guess is the cases will be dropped.

You can always call the AG's office and ask the status of the case or get an attorney to find out for you.
 
Very interesting, i believe if the charges are simply dropped then we would still have zero legal precedent as to the scope of the AWB as adopted by NYS, is that correct?

How are we supposed to determine exactly how non-collapsible a stock must be?

Are the courts purposely refusing to hear the allegations because they know it would be a slam dunk victory for the defendants?

I apologise for all of these questions, but im just very confused about how this is to be interpreted, as well as what it may mean for those of us who bought a postban rifle with a fixed collapsible stock from one of the stores involved.
 
/\/\ not if your located in the gunshine state... you could even put a zm recoil system on your ar and then install an actual shoulder thing that goes up :banghead: you lucky man
