WI: bill to ban private gun sales in Milwaukee county

State Senator Spencer Coggs (D-Milwaukee) has announced a bill that would ban the private sales of handguns in Milwaukee County.

Dubbed "The Responsible Gun Ownership Bill," the legislation would require private sellers to run a background check on buyers before completing the sale. Since few, if any, individuals have the capability of running a background check themselves, the checks would necessarily need to be done by a licensed dealer. The penalty for violation of the law would be ten years in prison and a $25,000 fine.

The statewide pre-emption legislation passed in the 1995/1996 legislative session prohibits municipalities from enacting gun laws more stringent than those at the state level. Thus, Coggs' bill would need to contain language modifying the pre-emption law, or a separate bill repealing or modifying the pre-emption law would need to be introduced.

If the pre-emption law is repealed or changed, it would open up a much bigger can of worms than just private handgun sales in Milwaukee. Municipalities would be free to enact all sorts of gun laws, such as the ban on handguns that Madison had in the early 1990's.

Mick Beatovic, owner of Badger Outdoors in Milwaukee, has endorsed the bill.

"The anti-gunners say, 'Let's do it.' The pro-gunners say, "Oh, My God. You can't do it' Well come on. Somebody needs to wake up, smell the coffee, alright, this is the way to stop it," said Beatovic.

Don't think this bill can pass? Just look at the anti-gun record of Senate Majority Leader Judy Robson (D-Beloit).

Please help kill this bill before it even gets off the ground. Contact your state senator and state representative, and tell them that you are absolutely opposed to "The Responsible Gun Ownership Bill." With Trader Sports (the second worst gun dealer in the country) getting guns off of its shelves for good, it’s time to go after number one: Badger Outdoors in Milwaukee, Wisconsin. Jim Stingl has a column in last week’s Journal-Sentinel that tells the story.

I wonder why that self-inflicted genius didn't just "dub" it the "Safe Streets and New Civic Happiness Bill."

If the founding fathers were still around, they'd tar and feather half the professional politicians in the nation.
 
Dick, have you seen a bill number for this? I read on the Mothers Against Gun Violence page that it was supposed to be assigned a number last week and then referred to committee. However, I can't find it in NXT.

If a local could confirm that Badger is indeed a dealer and does support this, perhaps we could call and let Mr. Beatovic know that gun owners will not do business with backstabbing business men out to make a buck.

I spent about nine months in Milwaukee doing constuction. Beautiful city, good food and beer. Friendly people. Socialist to the core though, too bad.
 
I went to Badger a number of times.

Bad tempered, and arrogant.
Dislike them with a passion.

I never really cared for being that close to so many other customers and shoppers who I considered thugs.

That may well be the source of their attitude.

They have low prices, and their guns have found their way to plenty of street criminals.

I prefered going to Shooter's Shop in West Allis, or even Fletchers in Waukesha.

I contacted Beatovic by phone right when this story first broke months ago (exactly how long ago escapes me). I believe I was tipped off to this by an email from Monkeyleg, a la WCCA’s mailing list.

Beatovic 1000% (one thousand percent) endorses this bill. From his mouth to my ear.

He's fallen to the "if it saves one life" mentality. This is one of a few of his lame rationales for supporting this bill. It's hard to say what his true motives might be, however one should consider that he's taken a lot of heat for firearms used in crimes being tracked back to his shop. These are not just local crimes but I believe crimes all over the nation. I think you can Google more on this stuff if you so desire -- my memory isn't that sharp on that subject.

But I can tell you with out a doubt this is no rumor. He supports this legislation.

I remember one comment of his on the phone was something along the lines of (this is not verbatim), "I have to run a background check for people I sell to, so why shouldn't the average guy have to do the same thing? It's not that expensive to run a check so the additional fees associated with a private sale shouldn't be a problem."

I suspect this is extra incentive for him... I mean unless it's built into the bill otherwise, dealers can probably charge whatever they like to provide this "service” with discounted back-ground check rates if you purchase in-store merchandise instead.
 
Two things:

1. If Gov Doink gets his way, the ".... it's not that expensive" comment will increase. In his proposed list of 'no new taxes', there is a fee increase that will change the background check (to FFL dealers) from $7.00 per check to $30.00 per check.

2. I don't think this bill will go anywere. My Rep., Jeff Fitzgerald, is the Assembly Majority Leader and I don't think he'd even schedule this for a vote, much less vote for it :neener: :evil:

Mick's one and only motivation is profit oriented. By eliminating private transactions of goods and establishing a legislated authority to market the same goods, creates a captivated market. The value of Mick's license just increased. Kinda like the old days of regulated freight carriers, where their "rights" to transport then became an asset. Mick's authority to sell in Milwaukee county would now become a transactional asset.

Coupled with his "better than thou" attitude, armed with his "authority", this would be one hell of a nasty place of forced business. Then again, Mick would be able to afford more gambling junkets!
 
Badger had 537 guns from their shop in 05' used in crimes.
Can you say straw purchase.

I'm surprised the ATF has not shut them down. Maybe the reason Mick sold his soul for a potential few pieces of silver.
 
Once again, I must come to Mick and Wally's defense on the subject of straw purchases.

Mick and Wally opened Badger in the late 1980's. They didn't open their shop in the ghetto; the ghetto came to them.

I know the extent to which they go to cooperate with and help the ATF as well as local authorities.

Back in 2000, when Badger made headlines for being the #1 shop in the country for trace guns, the newspapers omitted some pretty important information. For example, the fact that the Milwaukee Police Department is the only department in the country, IIRC, to trace every gun they find. Not just guns used in crimes.

Also, in 2000, Badger was cooperating with the ATF in nailing a guy who had done 26 straw purchases through the store. An ATF agent was on this guy for a full year. When his investigation was complete, the US attorney declined to press charges, saying that he couldn't establish intent. Nevertheless, the guy was nailed with state charges, and did some serious time.

I don't think that anyone who knows Badger's operation would ever accuse them of breaking the law.

As for the background check bill, do I disagree with Mick? You bet. And I've told him so. It runs counter to everything I believe in.
