SPRINGFIELD, Ohio -- A Tri-State woman is in critical condition Wednesday after police say her husband shot her while they were having sex.

Timothy Havens, 38, told Springfield police he was reaching for something on the nightstand when the pistol went off, hitting his estranged wife Carolyn in the upper chest. (Hear part of the 911 call)

Carolyn Havens, 42, is being treated at Miami Valley Hospital in Dayton.

This is isn't the first time there's been trouble for the Havens. Court documents showed Timothy served 60 days in jail for assaulting his wife and was ordered to go to anger management classes.

His arrest Tuesday for the weekend shooting was for violating a civil protection order that Carolyn had taken out against him earlier this year.

Bond was set at $75,000 after prosecutors asked for a high bond, "due to alleged prohibited contact between the parties (and) the suspicious nature of the circumstances surrounding (her injury)."

I was thinking what bad luck until I got to the estranged part.

I know a couple that have been divorced for a few years and they still have meetings;). It wasn't a nice divorce either. They claim that was the only time they got along so why mess with the part that worked out.

Why was he still allowed to have a firearm? IF, he had it legally?

I imagine if it was his - there'd be a much bigger uproar about it..

She takes out a "protection" order then helps him violate it.

At what point do we realize what a total fraud these "protection" orders are? At what point do we realize what unnecessary (for protection) and what total garbage they are? At what point to we get tired of how they are merely used as a tool and a weapon (since they do nothing for protection)? At what point do we notice the obvious and change the law to get rid of these idiotic and entrapping "protective" orders?

I've never heard of a "protective" order protecting anyone. However I HAVE heard endless examples of protective orders infuriating already violent guys and setting them off to go violate them. "Protective" orders are the adult equivalent of telling the teacher that someone is bothering you and the teacher giving the offender a talking to, which just gets him planning his revenge.
