Would you be prosecuted?

I was watching some hurricane katrina videos where the police were siezing firearms from law-abiding citizens. They were approached by law enforcement special agenst it looked like, and told that they were going to search their house. They had their guns pointed at these people and just pretty much busted in, took any weapons they could find, didn't offer any kind of record for the people who lost their firearms, they just took them.

What if someone decided to defend themselves? You don't open your door and you tell the LEO's that they should get off your property because you are doing nothing illegal, in which truly you aren't. If they busted down your door and you opened fire against them, were detained and thrown in jail and brought to court, would you have a standing case for innocence? I mean what these guys did was no different than what criminals do when they take your posessions, the only difference is that they have LEO badges.

I could understand if you were doing something illegal, but what if you aren't, your just sitting at home and this happens?

Curious to know how things would be handeled...
 
Illegal orders.

I didn't see any agency that protested or balked at carrying out blatantly illegal orders. If any DID object, they stood by without lifting a finger to protect and serve. They certainly weren't going to come to the rescue of any citizen being attacked by a brother LEO unit.

You MIGHT have gotten by if you stayed silent and out of sight and the locks held. Maybe.

If you resisted chances are you would be dead and labled a terrorist, looter, or worse. Look what happened to the folks who DIDN'T resist...Pat Kronie still has the physical problems you would suspect when a big healthy California Highway Patrol officer attacked her.

She doesn't have her gun back either.

It's tough, but that's the way it is. I certainly believe my own eyes.
 
Whether you'd be prosecuted is hard to say. Mostly because your chances of surviving such an encounter if you choose to fight is damn near zilch as they usually have superior numbers and weapons, unless you have a really good defensive setup and some backup.

I'd like to think that if you survived you wouldn't be prosecuted, as the orders were blatantly illegal (and found so by a judge after the fact), but its an extremely gray area. The outcome would probably depend greatly on individual state law. Some states have provisions allowing for the use of deadly force against an officer if their actions are illegal, others require you to submit no matter what.
 
I'm with the rest of them, you simply would not be around any more to pursue legal action, period. They arrive in large overwhelming numbers on purpose.

That beast of man attacking that old lady was despicable, but oh no, the media can't show how abusive our betters are now can they....... Was that elder lady Pat Kronie, the one with the revolver, with it unloaded, cylinder out and her fingers through the frame when that jackass pounced on her?
