I dont support any state that doesnt support the people and work for the people. As a matter of fact they are taking me to court over this very subject:banghead::cuss::scrutiny::fire:

Lawmakers in Columbus read the Dispatch, we need to nail this as we are losing. You can also tell the folks who are voting no think you are allowed to drink alcohol and carry. Not surprised our liberal antigun media has misled them on that...

?????? SB239 passed why are we losing?

?????? SB239 passed why are we losing?

That was the in the Senate alone and has to go to the House and Governor. We are no way near out of the woods yet. The Columbus Dispatch, Dayton Daily News, Toledo Blade, Plain Dealer and bulk of the newspapers have begun drumming up a campaign to stop the bill. We were losing the Columbus Dispatch poll when I first posted, we are now at 57% for 43% against. We need law makers to see the bulk of buckeyes want this bill passed. ;)

My response:

Consuming alchohol while carrying a concealed firearm is a felony, and will remain a felony when SB239 is passed into law. CCW licensees are required to know and follow the law, and will not risk criminal prosecution and potential loss of their 2nd amendment (and other) rights just for a beer. Criminals, on the other hand, disregard laws as a matter of course, and will illegally carry firearms whenever and wherever they please regardless of the law. Disregard for the law is, by defininion, what makes them criminals in the first place.

Now at 60%-40%, we should be doing better than that and I know why. Looks like can vote multiple times and it will let you. I think our opponents probably know this...

Well, voting early and often works in Chicago; we should learn from that. Nothing wrong with adopting your opponents tactics when they are effective - I have posted a couple of times myself.

From http://www.legislature.state.oh.us/bills.cfm?ID=128_SB_239

To amend sections 2923.121, 2923.128, and 2923.16 of the Revised Code to permit a concealed carry licensee to possess a firearm in liquor permit premises, or an open air arena, for which a D permit has been issued if the licensee is not consuming liquor or under the influence of alcohol or a drug of abuse and to modify the offense of improperly handling firearms in a motor vehicle as it applies to concealed carry licensees.

I'm pro CCW, but I wonder, how many people go to a bar not to drink? I bet a lot of CC holders break this law repeatedly. Some won't sure, those that go to a bar to hear the music or to eat, or to hang out with friends. But most will drink. Thoughts?

Merlin -

Restaurants serve alcohol. I'd like to be able to carry at my local bar and grill, I never drink when I'm eating a meal.

You're missing the big concept here, a large fraction of eateries serve alcohol, and the number of people in a bar not drinking has no relevance on the rights of those people to effective self-defense.

Thoughts? I think your opinion of concealed carry holders isn't consistent with your claim of being pro CCW. You really believe a person who jumped through the hoops to get a CCW are unable to resist drinking if alcohol is close by? The Ohio law is not BAR carry, it's for carry into say an Outback, Texas Road House, or any of the variety of theme eateries. Even assuming it's Bar carry shows you're not quite as open to concealed carry as you claim.

Somewhere around 40 states allow carry into places just like Ohio's law would allow, with no problems. Are Buckeye's unable to resist drinking at Outback in your opinion?

My thought? You're likely the first card carrying member of the Brady Campaign I've ever responded to a post they put in.

This bill doesn't go far enough.

I started a seperate thread in legal so as to not hijack this one...

Thoughts? I personally don't give a hoot about bars. It's the liberal media that keeps beating the drum about guns in bars.

Get this through everyone's heads- This change was primarily intended to allow carry in restaurants.

What I, and most of my fellow Ohio law-abiding CCW holders want, is to be able to go to a restaurant which also serves alcohol- let's say Applebees, for example- to eat a nice meal- AND NOT DRINK ALCOHOL- while not having to worry about catching a felony charge for being armed in an establishment that serves alcohol, or having to leave my gun in the car in the parking lot.

Ohio's CCW law makes no distinction between a bar and a restaurant. Anyplace with the "D" liquor permit is expressly forbidden in those places in O.R.C. 2923.126 "Duties of licensed individuals".

When I've travelled in other states that honor my Ohio CCW but do not disallow restaurant carry, it's been- refreshing. Nothing odd happened. Nobody got shot. I had a nice meal, and didn't drink alcohol.

In MI a person with a CPL may carry in a bar or restaurant that serves alcohol providing that the establishment derives over 50% of their sales from non alcohol products.
Some of your better bars will not post their profit factors--if you carry there you are taking a chance.................
Blow .02 on the drunk-o-meter while carrying-----------get your head between your legs &............................:eek::eek::eek:

I just want freedom to eat at any restaurant when we stop, I carry all the time when out and about and I believe I'm responsible for my gun and I can't have the proper control over it when it's locked in the car.

So I have to choose a restaurant that isn't class D to maintain my control and places like my local Mexican restaurant lose business because of the law.

If you look at the number of people killed either inside or right outside of bars, I betcha more people have been beaten to death than shot.

You should be allowed to carry a defensive handgun anywhere the possibility of an encounter of the violent kind could occur & an establishment that serves booze is definitely one of those places.
There's never any justification for CWI (Carrying While Intoxicated) but you could be in the bar doing things that don't involve drinking.
I don't drink but I visit bars & restaurants that serve booze on business related matters.

I don't know what the law says but BAL should be "0" when carrying.

What separates us from the crooks who carry guns is that we are law abiding & responsible.
