Is this even legal under the 7th Circuit Court of Appeals?





And I don't mean the prohibitive price to exercise a right.

Sheriff Tom Dart said Sunday that he is proposing a concealed-carry gun ordinance to keep Cook County from becoming the “Wild West.”

Under the proposed ordinance, Dart would have the authority to approve or reject licenses of citizens wanting to carry concealed weapons, the AP reports. Licenses would also come with a $300 fee.

Sadly, this represents progress for Cook Cty.

Bet if this passes, the only people getting approved for CCW will be the wealthy and politically connected.
 
Sounds like the New York situation where people can get carry permits in some NY counties but they are NOT valid in NYC.
 
No matter how often the Antis get struck down, they try to hold on to their ideals. Supreme Court overturned the Illinois state wide ban on concealed carry and they are darting the line by making permits discretionary and expensive. But at least it is progress.
 
This will teach all those poor people!

They don't need to worry about protecting their, and their loved ones, lives.

All they need to do is call 911.
 
It's legal, state's can severely restrict carry rights. In california, about 95% of counties won't issue under any circumstances. The Heller decision by the SCOTUS affirms the individual's right to own a gun for protection, did not address carry issues.
 
It is the arrogance of Sheriff Dart that really enrages me. I heard him on local Chicago radio yesterday stating that in the absence of a state law he would issue this rule for Cook County, where he will decide of what constitutes "need". I guess he just knows he is wiser than the rest of us, and that a constitutional right is only valid if he agrees with it. He stated he certainly would not agree to let "just anyone" carry a concealed weapon, only those who "need one", in part based upon the zipcode of where they live. Whether or not such a law will be enforceable is unclear to me, but I have no doubt that his deputies will try to enforce it, putting anyone found in violation in real danger of criminal prosecution and extensive legal defense costs. I live about one hour's driving time west of Cook County, and this is just one more reason I have to avoid whenever possible even entering this county for any reason. When someone like this can get elected by the voters, the same type voters who are giving the Police Chief of Chicago McCarthy highly positive polling data (who is totally against concealed carry for anyone except LEO's), there is not much hope for this crappy state. I've lived in IL for about 17 years, due to my job, and its interesting that never once can I recall a person saying that they are proud to be from Illinois. Even Abe Lincoln is probably rolling over in his grave over what this state has become.
 
Sounds like a "may issue" law. Did the court ruling require shall issue or just that an absolute prohibition is unconstitutional?

And somehow knows the "moral character" and circumstances of every random citizen who applies.

"May Issue" should only be legal in areas where the deciding authority is an elected, not appointed, official, and should have both an investigation requirement (since the supposed purpose of the rule is to allow the Chief to review each applicant) and a response deadline, which if violated, results in a permission being granted. If nothing else, such a rule would keep the Chief busy with reviewing applicants in lieu of getting other work done in a city as big as Chicago. "May issue" places enormous authority over a basic human right in the hands of one, or few people, and demands some sort of check and balance.

How the heck is requiring every single application, of tens of thousands, to go over the desk of one man anything but bureaucratic prohibition? Even if he approved every one, that's nowhere near close to fulfilling the demand pent up in that state by people who need carry weapons.

All they need to do is call 911.
And pray they don't live in one of those neighborhoods the cops won't go into anymore :uhoh:

My state is a trend setter!!! We've had that system for over 50 years now!
 
This is exactly the problem for Madigan. If she appeals to the USSC, she risks getting a decision which affects all the other states like NY and CA. For this reason Madigan needs time to craft an appeal. So far all she has been able to come up with is "the fed court ruling is inconsistent with other rulings". Insiders have said she is having trouble coming up with the actual items to appeal. I'm sure she will file the appeal but I'm not sure the court will hear it. The USSC has been keen to make a decision by simply denying to hear the case. Time will tell. Illinois put itself in a trick box by being way to strict. And our Gov. is a complete lefty so he is bound to push to hard and fail. Illinois differs from NY in that our down state is nothing like their upstate. On this issue Cook County has been getting its head handed to it.

What Dart wants is "may issue" (when H3ll freezes over!) with him in control.
Judge Posner's ruling was only in reference to Illinois' total ban, not any specific type of carry.
 
Dart is no dummy. Think of it his way. Thousands go thru the training and then submit their application with their $300. He denies them all, gets to keep the $300 and gets what he really wants, no one with a carry license.

Any Home Rule City could have their own laws that could be enforced. A good lawyer would probably get the case dropped unless the city is willing to go up against a Federal court ruling that said a out right ban is unconstitutional.
