An 80-year-old Chicago man shot and killed an armed man who broke into his two-story house in a pre-dawn home invasion Wednesday on the city's West Side.

At about 5:20 a.m., the homeowner and his wife, also in her 80s, discovered the intruder entering their home by a back door. In a struggle at their doorstep, the intruder fired his revolver but was struck in the chest and died of his wound, police said.

"It's a good thing they had a gun, or they might be dead," said Curtis Thompson, who lives next door to the couple, the Chicago Sun-Times reported.

Neighbors described the elderly couple, who both walk with canes, as pillars of the community in Garfield Park, where home invasions have been all too frequent.

Their neighbor, Shaquite Johnson, told MyFoxChicago that the two are "heroes" for fighting off the attacker — and that the shooting means there is "one less criminal" walking the streets.
"They don't bother no one, so why would anyone do that to them?" she said.

Relatives of the couple told the Sun Times that the man is an Army veteran, his wife a former nurse. Police said neither the man nor the woman was injured in the attack.

The assailant, who was described by police as being in his 30s, was found slumped on the back doorstep of the couple's house, removed four hours after the shooting, the Sun Times reported.

No charges have been filed against the homeowner, but Chicago currently has a statute outlawing the possession of handguns. Its legality is currently being decided by the U.S. Supreme Court.

A high-profile Chicago attorney has already stepped forward offering to represent the man pro bono if he faces charges for possessing a weapon.

"Self defense isn't just a right, it's a duty," said attorney Joel Brodsky. "If this man is prosecuted for saving his own life it's not just a travesty, it's justice turned inside out."

He won't charge him, he will twist or exclude the facts of the case and attempt to use it as another example of why the city needs harsher restrictions.

Good on the guy, by the way! And the lawyer too (didn't think I'd ever say that).
 
As an Illinois resident, I am extremely happy about this story. I am glad the man and his wife were not hurt, and hope this will only help Illinois
 
I'm glad for the old guy, to live out a long life to be snuffed out by a thug is no way to go.
He's an army vet by the way.
 
Here's my question: Does he still have a gun? You know the police took the one he used as 'evidence' and they ain't giving it back. Is now defenseless? If so, should we take up a collection or something. One of the things I've read over the years that often BG's friends, relatives, and associates will retaliate in a situation like this. I'd hate for this guy to be unarmed if something like that happened.
 
Amen to the lawyer who will stand up for the basic human right of self defense and defend this man for free. It just goes to show that stiff handgun laws only take guns away from law-abiding citizens. Thugs and criminals dont care if they dont have a permit. Hopefully this will end the violent home invasions that have been going on in that area. Chalk one up for the good guys.

I wouldn't at all be surprised if he's prosecuted.

Daley has the sort of casual cruelty toward and contempt for those he considers his inferiors that Kim Jong Il has.

"How are we going to protect our homes without guns?" the son said. "That gun law should be abolished. You don't need guns on the street, but you need them in the home for protection."

Actually, guns are needed just as much on the street as they are at home, but that's a debate for another time. At least he understands that guns are needed for self defense.


I hope the man isn't charged with illegally possessing a firearm in the city, but even if he's not, he will most likely have his gun confiscated and be left defenseless against the next lowlife who attacks him. :mad:

The suspected burglar, identified by his mother as Anthony Nelson, was pronounced dead on the scene. Nelson was on parole after being sentenced to three years in prison for a 2009 drug conviction, according to Cook County and Illinois Department of Corrections records.

Nelson (see prison photo at right) had a criminal record that includes a number of other drug or weapons convictions going back to 1998.

I, too, live in Illinois, and am tired of this state being run by a corrupt government that focuses on Chicago. And we all know how terrible their 'gun ban' is going (In case you don't, one of the worst crime/murder rates in the country right now). I hope they will see that loosening the gun regulations will only help those who need it the most.

As mentioned, the criminals don't care about the laws. So the only thing the laws are doing is keeping guns from those who use them properly
 
Just this past week in Roanoke, Virginia we had an 80 tear old man beaten to death by two of his boarders. Too bad it couldn't have turned out this way instead:(
 
The man just purchased his handgun several months ago after an earlier break in of three armed men who got away with $100. Good for him.
 
If the homeowner violated the law, he should be charged. That's the only way to get rid of Chicago's insane ban on self-protection.

Chicago's complete handgun ban is bad, but arbitrary enforcement of the law is worse. Charge him and let the city defend its position. Ought to be entertaining.
 
Daley knows that if he charged this elderly vet there would be a backlash that would undoubtedly reach all the way to the US Supreme Court. It very well could make the majority's decision at the end of June even more intrusive.

So, Daley.......go ahead and charge him.
 
Charge him, Mayor Daley! Do it! DO IT!

He's already got pro bono legal counsel, and this case would DESTROY the Chicago ban.
