Hopefully this veteran will not be charged.

The Supreme Court is currently hearing McDonald v. Chicago, which could repeal Chicago’s longstanding handgun ban. But justice may come too late for an elderly Korean War vet who was simply defending his 83-year-old wife and 12-year-old grandson.
The Chicago Sun-Times reports that this man had been robbed at home “a couple of months ago” by “three intruders.” Afterwards, he “bought a gun and vowed never to be a victim again.”
Around 5:00 this morning, 30-something Anthony Nelson broke into the home by breaking out a back window that leads to the elderly couple’s unit. There was a confrontation between the home invader and the homeowner, and the invader shot at the elderly man with his revolver. The homeowner shot back with his handgun, killing the attacker.

But...but...the 30-year-old was somebody's son, who had his whole life ahead of him, and he was just about to get his life back together when the killer, who has probably killed other young men before, used an illegal assault weapon in a premeditated act of retribution!

Well, that's how some would view this incident, anyway. If the homeowner is charged with any crime whatsoever, then I hope there is a huge public outcry and demand that the charges be dropped (and that they are dropped). I don't think that would hurt the McDonald case one bit.

I think that this case could very well help the McDonald case by giving an actual illustration of the harm that Chicago's ban HAS caused. I also hope there are a million lawyers lined up by this guy's house offering to defend him in court.

Arguably, this incident could bring to mind the equal protection clause in addition to the due process clause, at least as an influence in the minds of the justices, if nothing more. I won't say that a home invasion and shooting are fortuitous events, of course, but I will say that if this had to happen anyway, then the timing and initial public reaction (at least of folks living under similar conditions) couldn't have been better for our cause.

Not sure about the accuracy of some of the things in this article. How could Anthony Nelson possibly have been in possession of the revolver that was allegedly used to shoot the homeowner? The Chicago handgun ban explicitly prohibits such possession.

None of this would have happened in the first place if burglary were made illegal. And while our saviors are at it, they should outlaw murder, as well, to ensure that nobody will ever get killed by another person again. :p

Since the perp was illegally carrying and the homeowner's gun was also illegal, and both got shot, it should be a wash! It's Nelson's bad luck that the homeowner was a better marksman. Besides, if the old man gets any jail sentence, they'll owe him time since he's exceeded his life expectancy.

this 80 year old war vet needs to be appointed governor of illinois AND mayor of chicago..................its time to bring back government by, for & of the people.

A pawnshop owner in Chicago just shot a would be hold up guy about a week ago too. The news stated that the owner wasn't being charged with illegal possession of a handgun as of yet. Looks like the good guys are fighting back, reguardless of the law.
