A friend of mine went to buy a shotgun at Wal-mart

He told me he went to a Wal mart and wanted to buy a Remington 870. So the lady at the counter calls for the background check and then tells him he has to wait 3 days. :confused: The same thing happend to my brother in law at the same Wal-mart. Both have clean records so I don't understand?

I have never had such a problem. What's the deal??
 
Never heard of that. I just saw a shotgun bought at WM and it was
paid for and the manager carried it to the front door and said thanks.
 
What state? And are you saying you've bought a gun there and got it the same day but they've had to wait? I cant think of anything that would cause that kind of delay unless they were having a problem with the background check.
 
Well they live about 60 miles north of the Twin Cities here in Minnesota.
I don't think BC's vary by county??? I don't know but somthing smells bad.
 
Threre are three conditions in the NICS system, Proceed, Delayed, or Denied.

Now that there is the 24 hour records purge requirement, delayed will have new meaning. Inf fact we just got our new "0000NICS free pass cards a couple of weeks ago."

New FBI NICS Proceed 24-Hour Destruction Period

Section 617 of the 2004 Consolidated Appropriations Bill, passed by congress in January, dictates that the NICS implement a 24-Hour destruction period by July 21, 2004. This requires the destruction of all identifying information in the NICS Audit Log relating to a lawful purchase within 24 hours of delivering the "proceed" message to the Federal Firearms Licensee (FFL).

FFLs will no longer be able to contact the FBI NICS Section and reference a previously Proceeded NICS Transaction Number (NTN) to a current delayed NTN, on the same subject, to help expedite the final status on the delayed transaction. Within 24 hours after the FFL is notified of the Proceed status (by the start of the next business day at 8:00 a.m.), information will be purged from the system and the FBI NICS will only maintain non-identifying information on the Proceeded transaction. The FBI NICS will not have access to any of the buyers identifying information (name, social security number, miscellaneous numbers, and etc.) after the FFL being notified of the Proceed status.

What would be a reason for a "Delayed" return?
Many and varied. As my FFL explained it to me they have both positive and negative flags in the system. If all the positive flags pop up with no negatives you get an instant approval. If very few positive flags crop up, and especially if any negative one do so you can be delayed while they check into it further. It could be anything from you having a name similar to a convicted felon (usually cleared up if you provide your SSN) to the fact that you've been buying a lot of guns recently, to you name it. Delays can also be caused by the system being down (blue screen of death, power outage, etc) or just overburdned by calls at that moment in time. If you are delayed the FFL is obligated to prevent the transfer until you come back approved (anwhere from 1-3 days). But if after 3 days you are still listed as delayed the FFL can procede with the transfer. If you later come back as denied the FFL is informed but otherwise he does nothing. It's up to the .gov at that point to get the gun.
 
Delays happen for many reasons, lots of them innocent. Two pruchases ago, my purchase was delayed for the same reasons several others have been: my name. My name it seems is more than common, bringing up flags on it alone, despite other info such as SSN.

In this case howver it sounds like more of a local law or corporate procedure than the result of an acutal check.

It's been over a week and my buddy went back to get his shotgun and they said he is still delayed.

He might not be telling you the whole story.

IIRC, after three days a delay turns into a "give them the gun."
 
I'd see if I could buy it elsewhere, and then compare whether it was delayed there or not,and by how long. Personally, Iwould never buy a gun at Wally World anyway. It sounds like a problem with an anti or lazy manager to me.;)
 
After 3 days the FFL is allowed to proceed with the sale, but it's at their discretion. They are allowed to hold up the sale until in comes back as approved if they want. If he put a deposit on the gun, he has the option to either demand it back, or wait until his NICS check comes back OK. If he didn't put down a deposit, if I were him I'd go elsewhere.
 
The nice thing about a Texas CHL is that is allows you to pass up the Federal NICS check when you purchase...no chance for a delay! :D
 
Used to get my guns right then and there. Then got a DWI back in 2000 and its delayed at least a day ever since.

Bought a shotgun at wally world back about 3 months ago. (needed a shotgun and didn't have one... cheap but it works mossy) Came back delayed of course - and i came back the next day - watched them fuddle around w/ the paperwork and finally walked me to the front door and gave me the gun and off I went.

Dunno about this 3 days stuff... just relating a buying a gun in wally world experience i had....

problems with obtaining a new firearm, by way of the 4473
transfer of ownership form. Guess I might have chosen the
right profession, uh?

I wouldn't think being a retired LEO would have anything to do with it. I would of thought that maybe it's because you've never done anything that would cause a delay.
