A new 12 year old gun from Davidson’s?

I ordered an HK USP in .40 with tritium night sights from my local gun shop. I paid in cash up front as required. They ordered it from Davidson and I picked it up yesterday. When I got home, looking at the paperwork this gun was manufactured in 1994. The sticker from the manufacturer has it as being from the factory with night sights; this means that on my NEW gun, the tritium sights are already out of warranty, and half as bright as they should be. This also means that some of the newer features that I liked about this gun (loaded chamber indicator) are not incorporated. Is this normal from a company such as Davidson? Is there any thing that can be done? The shop I ordered it from doesn’t do returns, and as far as I can tell it’s not their problem anyway, they ordered a gun and received a 12 year old gun Davidson’s.

What are your thoughts on this? Am I out of line thinking this is wrong?

ETA: It’s been taken care of, everyone who said Davidson has great customer service was right!

first , i would ask the gun shop see waht they can do. if they wont, see then if they will at least call the mfgr, they would probably have more sway than just you. lastly , call the mfgr.
 
Contact Davidson's. They are supposed to have a Lifetime Replacement Warranty . I've never had to use it, but I would try them before HK.

I'm always amused at the misinformation surrounding Tritium. The half-life of Tritium is 12.3 years. This means that your sights might glow half as bright at that point since the initial activity is reduced to one half. Due to the structure and components of the vial, some barely glow at all at that point in time. Tritium is not made from from remnants of atomic bombs, it's a reactor byproduct or a direct product of neutron-bombardment of Lithium-6.
Anyway, to stay on topic, this is a tough one. Some companies will replace old tritium vials, not sure about HK. Gonna have to start with the local FFL first. Good luck

That’s what I have heard from everyone too, so I just wanted to make sure that this wasn’t an unreasonable concern before I called them.

I do know quite a bit about Tritium, the half-life is about 12 years, meaning that theses are only half as bright as if they were new. Most people I know only keep tritium sights for 6 or 7 years and then replace them; these are already older than that. That’s what my concern is.
 
That really sucks, if I were you I would call Davidson's they have good customer service from what I have heard.

I know this issue was resolved, but just curious as to if there aren't any other shops that are near you, as I wonder why one would do business with a shop that won't do returns on "New" products. Hell, one of my local shops will take a return on a "used" gun, and while they won't do a cash refund on used items (they will on "new"), they will at least apply the total purchase price (including tax) toward another item, new or used.
