Another delayed/denied thread, with a twist

For the first time ever, I ordered a couple of pistols (M&P 9 and Ruger Mklll)online and made arrangements for the local pawn shop to do the transfer. Went to pick them up and for the first time ever, my NICS came back delayed.

I do have a skeleton or two in my closet from about 25 years ago but I've immediately passed the NICS a few times in the past including about a month ago when I bought one of those evil Marlin Model 60 .22 assault rifles from that eviler retailer, Wal-Mart. The research I've done re my skeletons ( 1 Class A misdemeanor and 1 "unclassified" misdemeanor) leads me to believe I would not be precluded from buying a firearm unless I'm missing or misunderstanding something on the 4473. A caveat-about two weeks ago I called the county where my offenses occured and ordered a copy of my record. Is it likely that it flew under the NICS radar until they generated the report for me?

If I'm wrong about my past not precluding me from buying firearms and am ultimately denied, do I have to worry about the stormtroopers breaking down my door to get the guns they approved already? Is it unusual to get approved a few times in the last 10 years and then get denied? Also, what do I do with the guns that I just ordered? I can't take them down to the post office and mail them back, if the seller (well respected internet retailer) will even take them back. Prior to finding out about the delay, the pawn shop told me they aren't set up to return them if I didn't want them. He said it would be up to me to send them back.


Any guidance would be appreciated.
 
Firstly, a delay is not a denial. If the NICS system does not inform the FFL to NOT deliver the firearms, he may deliver them after 72 hours.

Secondly, you have provided too little information for anyone to give you an answer on your "skeletons". If you have a misdemeanor of Domestic Violence for instance, you are prohibited from purchasing firearms ala Lautenberg. Your actual offenses plus your state of residence would certainly help in providing an informed answer.

I wouldn't sweat it.For so reason I get delayed about 50% of the time.Sometimes the delay is 30 minutes, sometime a couple days. No idea why, but it always gets approved in the end.Delays, even for people with 00% spotless records are common. It just happens. Having a name similar to some felon, having something on your record that they need to verify or look at more closely, short staffed, happens to just be a busy day for them, etc are all likely reasons.If you wee cleared before, and haven't done anything since to prohibit you, you'll be fine. If by some unlikely reason you do get denied, they have an appeal process that I'm told works quite well.
 
I would find out the reason for the delay. Last year I was delayed in purchasing a used Colt Python. The system was down. I got a call late that evening that the system came up and the check was good. This happens quite often so I would not worry but do check the reason. If denied you can still appeal the denial.
 
There isn’t much you can do about a delay other than get a UPIN. I wouldn’t worry unless you actually get denied. Be careful moving out of state because your crimes will be re accessed by NICS personnel...
