The Heller ruling has opened up a lot more cases and I believe the lower federal court that started it is going to consider Parker.

Any chance for more favorable federal rulings before the election?

Any chance congress will get their finger out of their ,.. cookie jar, and do something favorable?

What about G.W. and the alphabet boys? They could rewrite regulations just about anytime in light of the Heller ruling.

Are you referring to the litigation initiated in the 7th and 9th Circuits?

I do not understand this. What do you mean?

You do know which party controls Congress, right? The Dems will likely maintain control in '09 and a new assault on our rights will begin in January.

What regulations are you referencing? What do you propose that would be rewritten.

I am curious as to what track and potential time-frame we can expect in the Chicago/SF cases. I've not heard this discussed.

We have Heller precident, so there will be no re-fight over individual v. collective. If we get incorporation, then the states precident will be set and the magic door opens to test what infringement and reasonable restrictions are.

Rule of thumb would be the time line for the DC circuit litigation. IME, the 7th's "rocket docket" local rules will push things along quicker than DC or the 9th.

Don't be so certain. The 9th Circuit will likely refuse to comply with the Heller's ruling of an individual right.

IANAL so I am confused. Can a lower court refuse to follow a USSC decision?

DC has said "Screw the Supreme Court's ruling, nobody's ever gonna be allowed a gun", so why wouldn't a lower court do the same thing. Doesn't mean it's legal, just means that they don't want to play ball.
