Background Checks For Ammunition Purchases

A friend of mine who lives in New York told me that he heard the state will soon require background checks for ammunition purchases and that the customer will be charged for the investigation. Anybody know how true this might be?
 
When one jurisdiction gets away with it, others are encouraged to do it too. These laws also make it more dangerous for sellers to ship to residents of that state, and this in turn angers the legitimate purchasers. There is no jeopardy for the usurpers, only enhanced tax revenue.
 
I have my doubts that the law will take effect but I fear it might succeed this time. They tried the same thing in 2013 and it failed because the state police were unable to get a background check system up and running due to incompetence/budget restrictions/technical inability.

Two specific parts of the bill make me think it wont happen:
A) There shall be a statewide license and record database specific for ammunition sales which shall be created and maintained by the division
of state police the cost of which shall not be borne by any municipality


They think 2.50 per ammo sale and 9.00 per firearm sale is enough to money to fund the entire system, or at least the state database they will have to create for this to become enforceable law. I believe lack of funding was part of what prevented it from taking effect when it was tried the first time.

B) All records containing granted license applications from all licensing authorities shall be monthly checked by the division of criminal justice services in conjunction with the division of state police
against criminal conviction, criminal indictments, mental health, extreme risk protection orders, orders of protection, and all other records as are necessary to determine their continued accuracy as well as whether an individual is no longer a valid license holder.


That's gonna require a lot more time/money/manpower then I think the state is willing to spend/has.

That being said, apparently FFL's have received a letter which indicates this will actually take effect, the NYSP had job openings suggesting they were in fact creating the system, and the NYSP website say it will be happening, so it not looking good.

If background checks for ammo actually becomes a thing here in the NY I might start driving to PA to buy ammo if only to deprive the state of the funds to continue their database.
 
I am so glad that I left both those states in the past.
And for now, I live in the "Free State"...

It only took a little over a decade to swing the pendulum, turning this place into the Peoples Republik. The antis have a lot of money, national educational indoctrination and a fully compliant media on their side. It didn’t take long to convince the sheep here that the wolves are friendly, and they are working right now in your states to do the same thing.

I saw the writing on the wall back in 1995 while stationed at Ft. Irwin Ca. I couldn't get out of that stye quick enough when I left the Army. California's gun laws were starting to get stupid even back then. But they weren't as bad a Massachusetts laws were while stationed at Ft Devens. in 1991

And right next door to me in the Peoples Republic of Illinois things are getting worse all the time.
 
Ya, from 1990-2000 stuff just rocketed downhill for gun makers, sellers and owners here.

The slide hasn’t subsided ever since.

Antis will do anything possible to further their agenda. Seattle passed a hefty fine on firearm and ammo sales in city limits. The businesses left, less people got legally armed, and crime went up. A right fined is a right denied.
 
Reloading really becomes the only solution in this case, which is why for stuff not 9mm or common rifle calibers I reload because this ammo background check purchase will spread thru blue states.

Unfortunately, we up here suffered that sort of hubris. We did not take action fast enough, and it totally bit us in the butt.

And I see the same sort of pollyannish thinking in a few other states in which gun owners feel secure in the belief it won't happen to their state.

I was based in SoCal in the early '90s, the laws were already stupid. We had the stupid DROS fee, the egregious waiting period, NO concealed carry, for anyone. Our SD county sheriff during that time would not even issue concealed carry licenses to reserve cops for off-duty carry. Thankfully, HR-218 was amended to provide for career military police and reserve officers and deputies nationwide.

I left a vapor trail behind me when I evacuated that state. I enjoyed a little more than ten years of excellent gun laws before this state went down the same road as California (although at least, up here we've always enjoyed shall-issue CPLs).

We already have cities up here (Seattle/Tacoma) that have extra taxes on ammunition.

Background checks for ammunition purchases will be, I believe, coming soon to every blue state near you. Don't know if the extra taxes will hold up under constitutional scrutiny, but wouldn't be surprised if they do.
 
I stopped buying ammunition when the rule came down for dealers to take down your personnel information for every purchase. Made all the ammo go behind locked cabinets. I reload all that I shoot and don't care to wait in a line to buy ammo. Its tedious enough and now I have to pay for the privilege to wait longer in line. Don't have time for it. My Amish friend is totally cut out of the market. Doesn't have whats is need to buy ammo. We made a deal that I would trade teaching him how to reload with helping me get my barn fixed. He just needs .270. Should be easy.

There is no place in the state that it wouldn't take a few hours to be past the border to a place that will sell you ammo.
 
If Democrats are so worried possible violence because of what person with guns and ammunition might do, why are they so eager to murder their babies and butcher their children they actually do every. single. day? Prohibition has never prohibited anyone from violating the prohibition. In fact, prohibitions literally generate violent crime. It's a crime that Democrats are fundamentally unwilling and unable to control street Democrat violence, but rather exhaust themselves religiously trying to control normal Americans who would dare to enjoy Freedom.

Decades of propaganda against firearms have the clueless determining your rights. It was done deliberately in the pursuit of making all of us subjects. The truth is they don't care about human life only power. Every citizen in the country should revere this most important Amendment. It's the one that protects the entire Constitution.

The background check and taxation have gone into effect. I suggest that New York run background checks on voters and bring back poll taxes.

Other parts of the law relate to concealed carry permits. Renewal is every three years. One also must submit their social media accounts. I guess the latter is to make sure the applicant has "correct thinking". One must never offend Big Brother, don't'cha'know.

People who still believe in the Constitution are going to have to move out of socialist states. Difficult to find America anymore. The cancer of socialism is profoundly malignant. The urban areas are lost to it.


"ELMIRA, N.Y. (WETM) – Several new gun control laws signed by Gov. Kathy Hochul are now in effect in New York State. As of Wednesday, background checks are now required for ammunition purchases. Dealers will now also submit background check requests to New York State Police, instead of submitting requests directly from the FBI.

"To cover the cost of the New York State background check system, there is now a $9.00 fee on all firearm transactions, and a $2.50 fee for all ammunition sales.

"Other parts of the “Concealed Carry Improvement Act” went into effect earlier this month. The changes include:

  • New Requirements for Individuals Seeking to Obtain Concealed Carry Pistol Permits Include Firearm Trainings, In-Person Interview, and Social Media Review, Among Others
  • Conceal Carry Restrictions Apply to Sensitive Locations Including Times Square, Bars, Libraries, Schools, Government Buildings and Hospitals
  • Permit Recertification or Renewal Now Required Every Three Years

"The new requirements to obtain a concealed carry license are:
  • proof of completion of a firearms safety training course;
  • four character references;
  • a list of former and current social media accounts for the last three years;
  • disclosure of applicant’s spouse or domestic partner, any other adults residing in the applicant’s home, including any adult children of the applicant, and
  • an in-person interview of the applicant with the licensing officer/designee.
"Gov. Hochul signed the law last year in response to what she described as a “reckless decision” by the Supreme Court. In a 6-3 decision, the Court ruled a New York law requiring concealed carry applicants to prove a special need for a permit – instead of just self-defense – violated the Second Amendment. The new laws are the latest in a series of gun control measures signed by Gov. Hochul. "
