Banning Guns By Executive Order?

For any lawyers and judges out there - a question. If Lord Barry The Messiah were to issue an executive order through the BATF to ban private owner ship of guns, would it stick? I know this is far-fetched, but hang in here with me for a second. George Soros funds a group called Institute for Policy Research. IPR has advised Obama to skirt the constitution and do more through executive orders. George Soros has the progressive politicians in his pocket. Wouldn't doubt if the libs on the Supreme Court are on his payroll as well.
 
Many think that banning guns would be a good idea, even ecologically healthy, but I think something like that would put a lot of birds on the endangered list.
 
do you honestly think that if politicians passed a decree to ban private ownership of guns.......that the american people would really give them all up.....?

sure, the people who are on the fence and only own a gun to own it might .......but someone who considers themselves a "shooter"....i highly doubt it

i mean, i would hate to be that collection agent......

they may make laws that make new guns hard as hell to buy......but to outright ban ownership i feel will never happen.......not in one swipe anyways.

No, Obama cannot circumvent the Constitution via Executive Order. Executive Orders are interpretations of law and regulations to enforce law, they are not laws unto themselves.
 
Executive orders aren't just pieces of law uttered by the President. Executive orders only have any authority over the executive branch of the government.
The president CAN order the BATFE to enforce more/less strict compliance with exisiting firearms laws passed by congress.
The president CANNOT order the BATFE to confiscate legally owned firearms. (For a number of reasons)
 
I hope this is an academic exercise only because this would never happen. Legally, I don't really know. Ask a lawyer. They ignore lots of laws these days and they seem to get away with it.

In practice though? NEVER. I don't know of a single gun owner who would give up all their guns just because they were declared illegal. And at that point, me and everyone else who owns a gun would pretty much say, "hey, if I'm gonna be treated like a felon, I might as well be a felon!" The politicians responsible would never be safe above ground again. It would be open season, no limit, on the perpetrators of this.

There would literally be chaos in the streets if agents were sent door to door to enforce this.

It would be more worthwhile of your time to worry about laws that affect future gun rights. Like two or three generations down the road.
 
i dont know about chaos in the streets.........just because the law says im a "bad guy".....doesnt mean im all of a sudden going to start acting like one........


if something like this did happen, i would most likely hide my guns and lie when they came looking for them....


--"hi im here for your guns..."

"oh, youre here for my guns.....oh i got rid of those pesky things years ago..."

--"are you sure?....you do know its a felony to keep them now..."

"yup, dont have any"

--"well thank you for your time"

That's the whole point of this so-called academic exercise as you put it - they seem to break lots of laws.
