I don't understand this stuff so someone explain.

Is there a ban now on pistol braces or is the ruling still being discussed?
 
ATF issued its "final rule". Once published to the Federal Register there is a 120-day period for owners and FFL's to decide what they want to do (replace the existing barrel with one 16" or longer, remove the brace, turn in the firearm to ATF, destroy the firearm), after which possession of a braced pistol would be illegal. Obviously many questions, like how can the ATF decide something's illegal, isn't that the job of Congress? SAF has filed suit, GOA says their sister organization will shortly be filing suit, and the NRA says it will also be filing suit. Meanwhile Rep. No, pistol braces are NOT banned. A pistol WITH A BRACE will become a Short Barreled Rifle, and therefore subject to the National Firearms Act.

Nothing is still being discussed, at the BATFE. Discussion ended some time ago. A federal court may intervene, or congress may change the law.
 
Until actual publication in the Code of Federal Regulations, you may have options that will terminate upon publication. Educate yourself, act while you can, and stay tuned. No one has a crystal ball.
 
A point of clarification: if one chooses to wait out the 120 days and just take off their brace in anticipation of the rule getting overturned later, you will also have to take off the buffer tube with adjustable notches and put on a smooth, round buffer tube otherwise you will still be in violation of this ruling. Just an FYI.

If you leave a carbine buffer in place after the 120 days AND have a brace, then you are in constructive possession of a SBR. Now whether you are prosecuted or not is another matter. And it is clearly stated in the document that if you have a braced pistol and did not submit a Form 1 within the 120 days then you will be in possession of an illegal SBR after the 120 day grace period..

I got that info from the video regarding the ruling by iraqveteran8888. Chad mentions it in the 2nd half of the video.

It is discussed more fully in this video, referenced as starting on pg 163. The gist is that unless that part is absolutely necessary for the function of the firearm it is prohibited, including anything that would easily allow re-attaching a brace or stock such as a folding adapter or buffer tube with adjustment slots.
