Burglary Suspect shot, killed in mobile-home lot

A Floyd County man was shot to death Tuesday night while attempting to burglarize a double-wide trailer in an Eastern Kentucky mobile-home lot, Kentucky State Police said. The victim, Ronald Dillon, 33, of Ivel broke into the trailer, where he was confronted by Mike Kurt, manager of Luv's Mobile Homes at Ivel, police said. Kurt, who was waiting inside the trailer at 10:08 p.m. -- he had been burglarized several times recently, investigators said -- shot Dillon twice in the chest with a 9-mm pistol, police said. Dillon, who lived next door in a mobile-home park, was pronounced dead at Highlands Regional Medical Center near Prestonsburg by Floyd County Coroner Roger Nelson. Police did not indicate whether Dillon was armed. No charges have been filed in the case, which is under investigation by state police.

A city inside the county I work for recently locked up a would be burglar who busted out a guys sliding glass door with a crow bar, entered his home and for some unknown reason began yelling, then ran like hell when the homeowner produced a shotgun.

We caught him (the burglar) a few hours later walking down the street, took him back to the house to have the home owner make a positive ID, which he did.

The burglar had plenty of mouth and was spouting all kinds of stuff; he was in the back of my patrol car as the homeowner thanked us for catching him.

I honestly asked the home owner, why he didn’t shoot the guy and the home owner kind of stopped talking and looked at me oddly, then asked could he have shot him, all four of us who were there said absolutely.

The burglar got quiet, then as we were giving him a complementary ride to his new address he just outright asked me if I meant what I told that man, I told him, without cracking a smile or even looking his way that I was shocked to find out he had not shot him.

For a brief second I think I made the man think about his actions, the fact he was armed with a crow bar not to mention he entered a man’s home at 4AM w/o permission.

He was lucky to still be breathing.
 
Every state is different, in GA, could he have shot the guy just for being in his house, or because he was in his house with a crow-bar. Here in VA the way it was explained to me is that you can't shoot an intruder in your home unless he is armed. My instructor said it all has to do with motive, if he just wants to break in and take your TV to pawn it for a rock, he isn't threatening your life. I only ask cuz I might be moving down to where my mom lives in Jefferson, GA, just up 85 a bit from Athens.

(a) A person is justified in threatening or using force against another when and to the extent that he or she reasonably believes that such threat or force is necessary to defend himself or herself or a third person against such other's imminent use of unlawful force; however, except as provided in Code Section 16-3-23, a person is justified in using force which is intended or likely to cause death or great bodily harm only if he or she reasonably believes that such force is necessary to prevent death or great bodily injury to himself or herself or a third person or to prevent the commission of a forcible felony.

They actually called the perpetrator the victim in that article?
 
And burglary is a forcible felony, even if the burglar is dressed like a hare krishna and unarmed.

FederalistWeasel, you sound like the kind of cop I would like on my case if I ever shoot a burglar.
 
Your comments to the perp, Did more to send him on the straight and narrow than what the courts will do. Good job.
