That is true, to a point. But BATFE considers the 01 FFL a business license and does require that an applicant be in compliance with state and local laws regarding the establishment of a business, including zoning. So if the licensed premises will be in an area zoned residential, the application may be denied. The result is that in such areas, the applicant is more or less forced to have a store front in an area zoned for businesses.

That depends on if the county, city or municipality prohibits that type of business at a residential address. Where I live, there is no such prohibition, and there are countless home based dealers, including FFL07/10 manufacturers.
 
Let's try to keep on track. The issue is what an FFL03 can and can't do.

Yes, if you want to be licensed as a dealer, you won't get the license unless you can legally conduct the business at the location at which you intend to do business; and that will be decided under local law.

But if you're going to be charged with being a dealer in firearms without the required license, whether what you're doing is kosher with the local zoning folks won't matter.
