C&R License question

Hey All

So I'm applying to get my C&R. One of the questions asks about if I have a hunters license (which I don't, I don't hunt). You either select yes or no.

Well, under the question, it says "If you answered NO, you likely cannot lawfully possess a firearm and therefore cannot be a federal firearms licensee"

I wasn't aware I had to have a hunters license to 'lawfully possess a firearm'. Does this make sense? So am I going to be denied because I don't hunt? :fire:

Can anyone clarify this for me?
 
I've had my C&R FFL for about four years now. To be honest, I don't recall that question on the application I filled out but, like you, I don't hunt either & had no problems getting the C&R. If I were you I'd contact the BATF, I emailed them the other week with a question & they were very prompt & courteous with their reply. Their email address is: [email protected]

It specifically says:

Are you in possession of a valid hunting license or permit lawfully issued in the United States? YES ____ NO ____

1. If you answered "NO", you likely cannot lawfully possess a firearm and therefore cannot be a federal firearms licensee.
2. If you answered "YES", complete the following information, and attach a copy of the hunting license or permit to the application





I've had my C&R FFL for about four years now. To be honest, I don't recall that question on the application I filled out but, like you, I don't hunt either & had no problems getting the C&R. If I were you I'd contact the BATF, I emailed them the other week with a question & they were very prompt & courteous with their reply. Their email address is: [email protected]

I know I have the right app, it says "Curios and Relics Application" at the top :uhoh:
 
I don't doubt it. It still wasn't on the application that I filled out. I KNOW I would have remembered that! Having a hunting license or engaging in the sport of hunting has nothing to do with collecting C&R firearms.
 
That section (10) only applies to non-immigrant aliens. (and it says so under "Country of Citizenship" in section 9.) Skip it.

My question about C&R's is why don't all FFL dealers accept them? eg. CDNN sells some C&R guns but not to C&R holders.... today I bought a Russian M44 nagant from a local dealer.... my C&R was not good enough for them... I still had to fill out the 4473 form to satisfy them.

You are right. I emailed them and that's what they said.

I wasn't sure....I thought I may be looking too deep into the question but I wanted to be sure. Thanks

M44's are C&R and from my experience most places will have you fill out the 4473 but not call it in, they just file it with a copy of your signed C&R license for CYA purposes.
 
No, they take a copy of your FFL and log it out in the book to you with you FFL # instead of a proceed number, you already passed the background check, no need to do forms, that is why you paid your $30.
 
The clerks at Gander Mountain just want your $10. Their eyes glaze over when you try to explain that this obviously copied piece of paper gives you some sort of special status. They just keep parroting the response that the law requires them to blah blah blah. They don't know and don't want to know. My final response is to walk away.

A dealer is not required to accept a C&R ffl and can insist on doing the 4473+ NICS check. It is his call.
 
This why I didn't keep my C&R.Most dealers won't take it.I mostly used my C&R for cross border private sale buys of older guns or ordering from CIA,sog ect..
 
AH, well that is why I go to my LGS, he got hemmed cause he displays his collection, a very nice and quite substantial collection. His last inspection, they made him get an 03 and a separate book, correlated to each piece of the collection and a display number for each gun, so now not only it his shop a nice place to visit, but it's also a museum....

none of my LGS charge a "background fee", and every one I've been to has said they accept an 03, but I did have to explain to one counter guy that the original isn't signed unless you are turning it in, but I would be willing to sign a copy made by them.

The whole thing about getting a C&R is to have the ability to have C&R approved firearms shipped directly to your house.

You can save the $20-$30 on transfer fees from your local FFL. You can also deal with Gunbroker people selling C&R eligible firearms and they can ship them to your house.

I would imagine the reason some FFLs won't accept yout C&R is that they are not 100% up on what is eligible and they would rather be safe than sorry.
 
Well, if you happen to have several local dealers who happen to have a decent selection of C&R stuff, and they realize that it's easier to accept your 03, it's nice instant gratification. No shipping, hands-on inspection.

By their own regs, he would NOT have had to log any of them that he had owned prior to the 03 being issued.
 
Naw, I believe he argued that, but they considered it more like a museum collection, and that is something that I am not familiar with, but it was nice coffee and he has a hell of a collection

I remember the pained expression on the drivers face (FedEx or UPS, can't remember) when he lugged my new Mosin Nagant and tin of 550 rounds ammo off the truck! ;)
