I sold an SKS on gunbroker. I asked the buyer for an FFL; he gave me a copy of his Curio & Relic license. Does SKS fall under that provision? Thanks.

I believe if that particular SKS is on the Curio and Relic list (from the ATF, it would have to be at least 50 years old) then you can (as long as it isn't banned in the C&R holders state).

SKSs are usually C&R eligible as long as they don't have the removable magazine installed. That breaks C&R eligibility always.

If it's 50 years old it doesn't have to be on the list, but many things less than 50 years old are on the list.

Here's a link to the list:

Couple of dangers in SKSs.

1) Chinese and other variants were made for a long time, lots of them are not 50 years old yet.

2) Some people have questioned the Yugo's that had the grenade launchers removed. Feds say that you can't modify the rifle so removing the launcher might break that.

I've seen quite a lot of debate about it on SKS forums.
Going on year of manufacture seems to be the safe bet. But, some countries were still making them after 1960 (50 years ago) so be careful.

That sounds like "original condition" and 50 years old so I would say it's good.

Not a lawyer etc etc but those are usually the sticking points I hear people talking about; age, magazine mods, and sometimes bayonet.

I've seen it argued that removing the bayonet breaks C&R status too since it's no longer original condition.

I've bought a couple of Yugo 59-66 SKS's from dealers. Shipped direct, totally legal. Chinese SKS's are not C&R eligible (to the best of my knowledge.) Older Soviet ones (50 yrs old) are.
I believe that the Chinese SKS's are specifically exempted from C&R eligiblity, check with the BATFE to be sure, perhaps things have changed.

Romanian, Yugo, Albanian, Russian, N Korean and N Vietnamese SKS are all C&R eligible as long as they are in their orginal cofiguration.

Chinese SKS are NOT C&R eligible - because China refuses to provide the ATF with a way to determine when the weapons were mfgr.

A C&R is a type of FFL... It is an 03FFL "Collector of Curios and Relics". It has the restrictions of the holder only being able to use it to aquire C&R approved firearms.

50yrs old (or older) and in it's orginal configuration is the qualification for ANY/EVERY firearm to be classified automatically as a C&R - unless it is specifically called out in the list (for example some commerative COLT pistols and the little 9X18mm CZ82 which are less than 50yr old).
