CCW carry in car

We finally got CCW in Ohio. The only way to carry your firearm accessibly in a vehicle is "on your person, in plain sight " . "In plain sight" has yet to be defined by the attorney general.

So I came up with the idea of buying a cheap Uncle Mike's holster and attaching it to my right thigh with an elastic/velcro band. With the gun placed on the top of my thigh I will have ready access while still being within the law as it presently reads.

It sure beats a holster on the belt and it doesn't advertise your firearm to passing motorists like a shoulder holster would, in my opinion.

I'm so miffed about this "In plain sight" law. If your going CC out of the car, it should be the same way in the car as well. If someone could make sense of this, please let me know the reasons.

Hip or thigh works for me. I personally like the hip. It allows for a little more concealment and makes certain the firearm is next to you regardless of the circumstances.
 
So what do you plan to do if riding in someone else's car? Will you carry this thigh holster with you all the time? How soon will you tire of doing this and of explaining to your passengers what you are doing? Not very discrete, is it?

This issue is a major flaw in Ohio's CCW new law (as it was intended to be). But it will take AT LEAST a year or two to start fixing it. Some of us don't have the luxury of not associating with any anti's all of the time and will have to choose between not carrying some of the time or assume the risks of breaking the law some of the time. :fire:

I wouldn't risk a IWB holster. At least part of the holster is hidden, and if the Officer, Prosecuter, and a Jury disagree with you it's a felony.

Even if the Jury agrees with you, you're gonna spend thousands defending yourself in court.

Some legislators stuck a number of poison pills in the legislation, and I'm going to remember them for it come election day. However, what we have now is a nice starting point. Hopefully it won't take long getting it changed into a practical law.
 
I have read a lot of opinions on a lot of sights, not even the teachers who are posting here and there are able to say "this is how the law says it should be."

I still wonder about folks on motorcycles. You are not in the car so I guess it stays concealed.

I also wonder about folks keeping the gun where someone in an suv will be able to look down at you in your car and see your gun. Of course this also makes me wonder about keeping them on the dash or something so everyone on the road can see it. Max out the "he waved his gun, or man with a gun" calls and see what happens.

Right now I wonder while I save my money so I can hopefully take my class in the summer, looking like july or august right now.

Overall, I am thinking since I have places on either the center of my front bench seat or on the console between the seats to velcro a holster I will just do that. I want to trust the iwb with the shirt lifted, but that may not be the only way I wish to carry so the holsters velcroed in the car work a couple ways.

Of course I am now wondering about smash and grabs if I forget to stick the holster in the glovebox so it is hidden, or worse yet if I have a gun in the car and need to go in one of those places where folks with fbi background checks are not trusted to take a gun.

Just ranting and wondering and I am still pondering having to pay for the privelage of proving I can pass a back ground check, I can shoot a gun accurately, I can follow some stupid rules, I can carry a piece of plastic with my picture on it, and yada yada yada while waiting 45 days to gain a privelage that was written on some paper that is older than all of my elected nutballs in office.

At least now I have the choice I guess.

(E) No person who has been issued a license or temporary emergency license to carry a concealed handgun under section 2923.125 or 2923.1213 of the Revised Code shall do any of the following:
(1) Knowingly transport or have a loaded handgun in a motor vehicle unless the loaded handgun either is in a holster and in plain sight on the person's person or it is securely encased by being stored in a closed, locked glove compartment or in a case that is in plain sight and that is locked;

Your suggested method of carry is illegal and the penalty is a felony. This is just one of the many problems with this legislation and it will take a long time for us to fix it to make it bearable. I really have little hope of changing anything significant in the law until Taft is out of office in 2007. We must make sure that another RINO is not elected governor in 2006 or we could be dead iin the water for another 8 years.
 
this is a problem, me and some friends that were planning on concealed carrying were talking about this and the only method we could come up with was shoulder holster and just remove your jacket when you get in the car. but a shoulder holster doesn't seem ideal with summer coming up. i was thinking about getting a kel-tec .380 but it loses a lot of it's practicality with ohio ccw law. might just get a massiv cz-52 and falco shoulder holster.
 
If you were a criminal with malicious intent, you would not be having these problems with the way the law is written. :banghead:
 
This provision is in the law as a result of the direct insistence of the Highway Patrol. They originally didn't want anyone to be able to carry in a car - they wanted you to have to unload your gun and store it in the trunk. Then they 'compromised' and wanted the current provision if you were in the car with other adults and to require you to store your unloaded gun in the trunk only if there were children (anyone under 18) in the car. The current provision was their final position. Many of us believe they were acting on the orders of Governor Taft. Until we change the law we will have to work around this provision, but that probably requires a change in the governor first.

Handling a loaded gun each time you get into a car or out off one is more dangerous than just being able to leave it in you holster. One way to avoid multiple handlings would be to wear a cross draw holster and sweep the covering garment back to uncover the gun when you were in the car. I may use this carry occasionally, but it really doesn't suit me.

Depending on what I'm carrying, I'll either carry in a pocket holster or in a strong side IWB belt clip holster. When I get in the car I'll remove the holstered gun from my body and place it in a locked box on the front passenger's seat. With practice, I think I can do this relatively discreetly and with adequate safety.
 
Ken Blackwell (Ohio Secretary of State) is solidly pro-RKBA and will run in 2006. We need to put our money and our efforts where are mouths are.

I hope you're right. Ken had the chance to run before and stepped aside for Taft. Many think that he threatens to run for governor to induce the Republican Party to buy him off with other positions.

I have my doubts about this view. Ken is now heading a campaign to get Taft's tax hike repealed. Doesn't seem like something a good Republican Party Man would do.

If Ken runs we all need to work as hard as we can to support him. Donate time, money, and skill to help him get elected.
 
i'd really prefer to not have to lock away my firearm when i could be vulnerable to a car jacking. most likely when i'm at a stop sign or when i've arived at my destination and am about to get my gun and depart. what about when you're getting gas or getting cash from an ATM? you're not likely to take the time to reholster your weapon just to pump gas or go to an ATM even though that might be the most dangerous place you'll be. i try to remember to lock my doors but at least with a shoulder holster (left-handed) a car-jacker might see my gun before he jumps into the passenger side seat.

I want the gun fully accessable since I honestly feel most vulnerable in my car.

In reality, I will try and be discreet. But this stupid part of the law makes me figure some folks might as well not try and be discreet since the law makes that darn hard.

So, the next time I hear a cop saying, "We don't make the laws, we just enforce 'em," I can ask him what his department/union lobbyist has been up to lately.

One method which has not been discussed was fannypack (Galco, Eagle, Coronado) carry.

Once in the car, unzip the fannypack and the gun is both in a holster and on one's person.

Go OWB and wear a big T-shirt? That's how I conceal at work and home already.

In the car, just stick the shirt behind the holster so it's in 'plain sight'. :rolleyes:

Or, lock the gun up in the car, and carry a loaded semi-auto RIFLE in plain sight :) (can ohio-ans do this?)

Actually, Amended Substitute House Bill 12 changed much of 2923 - that was the whole point! 2923 was/is the section of the Ohio Revised Code that governs concealed carry. As to my accuracy, see below.

I hope this settles the issue. I know I'm new on THR and you are a moderator, but please get your own facts straight before you question someone else about their post. The reason that I'm so upset is that your post, with the prestige of being a moderator behind it, calling my newbie post into question might cause someone to act on incorrect information, which could get them into serious trouble with the law. Specifically, I made my post because what biere was planning on doing could get him convicted of a felony. I don't want to see any pro-gunner in prison because he didn't fully understand some of the legal landmines laid in this legislation.

P.S. A little more about my background in this area.

I've been active in working for concealed carry in Ohio since 1995 when I attended the hearings for Senate Bill 65, which was the first modern ccw legislation passed by either chamber in modern history. I've testified in front of House and Senate comittees on HB274 (the immediate precursor in the 124th GA of HB12 in the 125th GA) and on HB12 a total of five times and three times they asked questions (which usually indicates they found your testimony effective and want to learn more about what you think). Portions of my testimony in one instance formed the basis for a major article in The Columbus Dispatch by their statehouse reporter. I've also privately met with members of these comittees to provide further input on concealed carry.
 
Cope with it...

I plan to buy a steel box with a combination lock and store it and my stainless .44 revolver under the driver's seat 24/7 with a cable securing the box to the seat frame. There are so many places I'm not allowed to CCW that this seems to be the best option until the law is changed. For the few outings I'll have where CCW is legal/practical...well thats what I have the Kel-Tec .380 for.
 
Annoying isn't it. Here's your CCW pal. Oh buy the way you can't go here there or inbetween either:banghead: . The funny thing is most police are all in favor of law abiding citizens with guns.
